(34,124 posts)He can prevent her from testifying about communications made during the marriage in reliance on the sanctity of the marriage, when no one was present to hear the communications. They can divorce today, and he can still prevent her from testifying about that same body of communications - they just can't add to the communications she can't testify about. The maritial communications privilege is a fairly narrow privilege, but long-lasting as to anything that is covered.
The marital communications privilege belongs to her, not him. He can't prevent her from testifying about actions that took place during the marriage, but she can (in most instances) choose not to testify.
Under the testimonial privilege, she is presumed incompetent to testify against her husband in all but a few circumstances (marital testimonial privilege) - BUT - she can waive this presumption and testify if she chooses. And the moment they divorce, she is no longer presumed to be incompetent.
