A federal appeals court today blocked the DeSantis admin's Stop-WOKE law, continuing to put the policy on hold for Florida's colleges and universities.
U.S. District Judge Mark Walker called the law positively dystopian.
The 11th U.S. Circuit Court of Appeals denied a request from the DeSantis administration and higher education officials to block an injunction that determined the law restricting how race can be taught in schools was unconstitutional, ensuring that state officials are barred from carrying out the measure for now. While the groups that challenged the state are claiming victory over the ruling, DeSantis officials say the state will ultimately prevail once the case is heard.
Professors must be able to discuss subjects like race and gender without hesitation or fear of state reprisal, said the Foundation for Individual Rights and Expression, or FIRE, one group that sued over the legislation. Any law that limits the free exchange of ideas in university classrooms should lose in both the court of law and the court of public opinion.

The law officially bans professors from expressing disfavored viewpoints in university classrooms while permitting unfettered expression of the opposite viewpoints, wrote Walker. Defendants argue that, under this Act, professors enjoy academic freedom so long as they express only those viewpoints of which the State approves. This is positively dystopian.
Thursdays court ruling stems from two separate challenges to the Stop-WOKE Act that were heard together since they both fought how the law applies to higher education. Other legal challenges target K-12 schools and the workplace.

(16,519 posts)Of course it's unconstitutional! Its freaking un-American! If DeSatan had half a brain, he'd know that.
I hope this ruling stands, no matter how many times Florida appeals it. I still don't understand why people aren't up in arms and marching in the streets down there, but I'm glad some people filed lawsuits over this.
