Tensions flared at the Senate on Wednesday as Democrats wield their majority power to advance judicial nominations without home-state approval.

Saying she only learned Tuesday about the hearing for Mathis, Senator Marsha Blackburn slammed Democrats for not sending her a blue slip asking whether she supported the nomination.

“I do see it as a breach of constitutional norms," Blackburn said.

The chairman went on to note that 18 of former President Donald Trump's nominees made it out of the committee without consent from their home-state senators, a precedent he said Democrats have the right to follow.

And Blackburn is an idiot. The Constitution knows nothing of this 'blue slip'. The Constitution simply says the Senate sets its own rules, and is silent as the grave as to what these might be.

It is completely in his hands whether blue slips exist- the extent of their existence depends totally on the whims of the current Judiciary Committee Chairman.

From judiciary.senate.gov:

The blue-slip policy incentivizes consultation between the White House and home-state senators on judicial nominees, ensuring that nominees are mainstream and well-suited to serve in their states. For example, many senators use bipartisan committees to screen and recommend judicial nominees. The blue slip ensures the White House doesn’t ignore those bipartisan processes, which produce well-qualified candidates.

Democrats have almost always scrupulously adhered to this practice and traditional courtesy. "Smash-and-grab" Republicans otoh sometimes send blue slips to Republican senators but not Democratic.

Ergo, we should pressure Schumer to do what Mitch did -- pressure Durbin to ditch the blue slip norm.

themselves by complaining of policies their own party introduced when it works against them. They are clearly uncomfortable with anything resembling a level playing field.

What goes around, comes around.
Do unto Republicans as they have already done unto you (Luke 6:31, with adjustment for the US political scene).

It's just a matter of getting the job done in the face of Republican obstruction.
They need to get over it, and we need to use these tactics more often.
