Carroll was able to sue for civil damages only because of a recent change in New York law. The statute of limitations for people to bring civil lawsuits over sexual assault in New York is generally three years. But in 2022, New York passed the Adult Survivors Act, which opened a one-year window for people to sue their alleged assailants even if the statute of limitations had expired. But that has nothing to do with the statute of limitations for the state charging the crime of rape, which was five years at the time it happened. Criminal charges do not depend on the results of civil actions anyhow.
