(11,274 posts)Show a fake lease and the cops cant do anything. A lengthy process to get a court ordered eviction is required. You will win, but it is one hell of an ordeal. This is beyond anything I can wrap my mind around.

Its happening all over; an empty house gets taken over, they fake a lease to get power on & dare you to do anything about it. And they usually trash the house in the process. In some states, it can take you a YEAR to get them out. Totally unacceptable.
While THIS law is ridiculous there should be something more specific put into law to deal with these squatters.

(11,274 posts)Its mind boggling that someone can steal your house if you go on a month or two vacation whereas if an intruder comes in when youre sleeping you can freely shoot to kill.

I have only shot a gun once and I am not interested in guns
but if someone tried to steal something worth hundreds of thousands from me while thumbing their nose at me. Thats a tough one to let slide.

(11,274 posts)is astonishing. I dont normally think much about it but the nightmares do get reported on the news occasionally and it is beyond bizarre that the situation cannot be instantly rectified by calling the police or something. Kind of a helpless feeling I guess.

(10,430 posts)Only cases of "squatters who try to steal your home" that I'm aware of (at least in Florida) are people who file adverse possession claims. According to centuries-old laws, a "squatter" who occupies an abandoned property for seven consecutive years can submit an adverse possession claim in an attempt to take legal ownership. There are still antiquated law on the books allowing adverse possession, but it's not legal in most places.
From the Florida Times-Union: "The Jacksonville Sheriff's Office recently arrested four people on charges of taking part in an organized scheme to defraud. Authorities said the suspects, each charged with grand theft, illegally took over vacant homes and either lived in them or rented them out...'They had no lawful right to the residences at all, never had it...Filing for adverse possession on a piece of property is one thing. But to formally acquire it through that process is another,' according to Jim Lima, land records division chief in Duval County."
"In order to acquire a piece of property, an applicant must file a claim, pay the taxes on the property for seven years and either cultivate, improve the property or live on it throughout that period. Once seven years have passed, the claimant can petition a judge to give him or her the title...Changing the locks on or breaking into a home you don't own can be criminal. Also, the owner of the property needs only to pay taxes on the property once during the seven-year period to have the claim withdrawn."
"The Duval County Property Appraiser's Office has received three adverse possession claims this year...Prior to that, in a 10-year stretch, there was one...In terms of acquiring the title to a piece of property, the adverse possession route has not been successful."

(10,430 posts)Do you seriously believe there is a nationwide epidemic of squatters breaking into other people's homes, changing the locks and taking up residence there...and nothing can be done about it? Just because you found a few articles about a few criminals doing it?
These are criminal acts. People commit all manner of crimes. You call the police and have them arrested.

(10,430 posts)If a tenant or homeowner refuses to leave, for non-payment of rent or a mortgage foreclosure, there is a legal court-ordered process to evict them. That process takes time, both tenants' and property owners' rights have to be protected. If/when legal eviction notices are ignored, the police will ultimately force the "squatters" to leave the premises, by force if necessary. That sort of thing has been happening for centuries in this country. It is not "breaking news."
However, cops do not have legal authority to go into a home where "squatters" are staying, guns blazing and shoot everyone inside the home. And if you will recall, that's what this thread was originally about: some crazy legislator wants to make it legal for police or civilians to shoot people who are committing non-violent property crimes (things like squatting). One poster reponded that he would be justified shooting people if they tried to "steal" his home. I and others disagreed with that.
There is no national epidemic of "squatters" randomly breaking into innocent people's homes while they're away, changing locks, moving families in, forging documents stating they have some legal right to live there, assuming "ownership" of the property and then refusing to leave. That's a crime, not a civil dispute. It's called B&E, burglary, vandalism, trespassing and fraud. If it happens to you, call the cops.
The articles you cite are alarmist hysteria. It's the sort of thing local news outlets love hyping to create fear and outrage.

(12,745 posts)NO THEY WONT. The squatters will say the documents are legit; I'll say they're NOT. the cop wont know who's telling the truth & they'll say "Its a civil matter". As I said before this "law" they're trying to pass is ridiculous. ABSOLUTELY ridiculous. But every state needs to put something in place to deal with this problem, which IS big whether you & others want to believe it or not. Insurance products are even being sold to cover it; that doesnt happen if its "rare". it happened to ME in a smaller sized city. Fortunately I had other ways to deal with them.

(6,967 posts)It will be a real challenge to craft a change to existing law which can strengthen the enforcement of property rights by owners and remain constitutional. I doubt Jared will be up for it. Those fools can pass such a law, but it won't pass Ky Supreme court review or constitutional muster.

(32,849 posts)He rents out one of his properties and I sarcasticly told him that if trump gets back in, he'll be able to shoot and kill anyone who overstays their lease or Airbnb stay.
However, I know that he will read the rest of the graphic and I know that he understands that laws like that would essentially make lynching legal again. Millions more Trayvon Martins, shot dead by wannabe cops, except now there would be no fake trials where the prosecutor pretends to be defending the law.
I've been working on my brother for the past few months because a year or so ago he told me that he's done with the Democrats. I think I'm making a lot of progress with him though. A lot of what I've told him is sticking.
