What this ruling implies by giving Trump until the 12th to appeal to the SC is that the Appeals court en banc is not going to take an appeal.

Yes, the Supreme Court can shut down Jack Smith and others but it will eliminate a further Trump delay by going en banc.

Weissmann just said that Trump will appeal to the SC and he expects the SC to give a decision within 2 weeks whether or not it will take the appeal. We should know by the end of February what the SC is going to do. I was wrong about one thing, because the Appeals court was so thorough in its decision it will limit the Supreme Court from delaying its decision if it takes the appeal.

We got more time to have the trial but en banc won't happen, it will be up to the Supreme Court.
