"The issue of what effect Section 4 has regarding the debt ceiling remains unsettled.[52] Legal analyst Jeffrey Rosen has argued that Section 4 gives the President unilateral authority to raise or ignore the national debt ceiling, and that if challenged the Supreme Court would likely rule in favor of expanded executive power or dismiss the case altogether for lack of standing."

(25,242 posts)If this is constitutionally sound and SCOTUS would support it - under what grounds could the Repugs impeach the President?

(11,304 posts)Maybe because he is the black man in office who is popular with the people because he cares. They are trying to find something to impeach him on. I wouldn't be surprise if gun control they will try that. Who knows they are nuts. Of course right now I know none of this is going to happen. I'm just answering the question and having some fun with it.

(22,144 posts)If the administration tried I would expect and emergency appeal to SCOTUS which based on precedent and the current court members, the current administration would lose.

(112 posts)What would happen is that the Treasury wouldn't be able to issue any new debt debt beyond the ceiling. The fourteenth amendment merely requires that any debts that are due be paid before government operational expenses. That being the case, the president would pay the debt bills as they come due and then the administration would have to determine what items to fund and at what level with the remaining money.

(15,689 posts)then after you told them about the unconstitutionality of Congress refusing to pay for expenses and debts already incurred by acts of Congress, and how the government was going to proceed to meet its obligations regardless of their illegal "debt limit", it would REALLY get bad.
They'd impeach Obama lickety-split. And it would go nowhere of course in the Senate. And that would be the end of it. Considering the malicious shit they will otherwise occupy themselves with if they aren't busy impeaching Obama, this is probably the best use of their time and so they should be fully encouraged to give into their lynchin' predilections in televised impeachment hearings.
