(DUer) Carlos Miller Arrested For Photographing Police Crack-Down on Occupy Miami

"Local journalist Carlos Miller has a blog called Photography is Not a Crime. Apparently Miami-Dade police officers are not avid readers.

County cops arrested Miller on Tuesday night as he was filming the Fuzz forcibly evacuating Occupy Miami protesters from Government Center downtown. But he says the police are the ones who messed up.

"They took a routine bullshit arrest and turned it into a huge constitutional violation and a possible federal lawsuit because they deleted my footage," Miller says. "They messed with the wrong reporter."

Miller says that the police were actually doing an admirable job clearing Government Center without violence. But when he asked a policewoman if he could move past a phalanx of officers in order to get to his car, he says all Hell broke loose."

Carlos is the real deal, and police suppression of photogs is his pet issue. This is SO gonna end up in court, and not the way the Miami cops are accustomed to either. I do wish he'd return to DU, he was one of the good ones.

Forensic software can then recover the files.

Which is why when you're disposing of storage media, you should either physically destroy it or do a low-level format and then overwrite it
multiple times with some innocuous files. Large numbers of public-domain text files from the Gutenberg Project work nicely...

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

False arrest and fabrication of evidence: The Fourth Amendment of the U.S. Constitution guarantees the right against unreasonable searches or seizures. A law enforcement official using authority provided under the color of law is allowed to stop individuals and, under certain circumstances, to search them and retain their property. It is in the abuse of that discretionary power—such as an unlawful detention or illegal confiscation of property—that a violation of a person's civil rights may occur.

Fabricating evidence against or falsely arresting an individual also violates the color of law statute, taking away the person’s rights of due process and unreasonable seizure. In the case of deprivation of property, the color of law statute would be violated by unlawfully obtaining or maintaining a person’s property, which oversteps or misapplies the official’s authority.


And seeing as the Justice Department told the Miami-Dade P.D. last month rather explicitly that photography and/or videography of their activities was
legal, well someone's will be in a heap o' trouble for this. and it won't be Carlos...

I guess they still haven't learned their lesson. This story is now all over Twitter.

Do any of the other oldtimers remember Carlos, aka Jiacinto? As I recall, he was really argumentative, but his heart was in the right place. Any chance Raging & Jiacinto are the same person? Thank you.
