One where many Democrats are up for reelection this year, and might chicken-shit their way into making trouble for a replacement nominee in order to bolster their independent cred?

they can again harp on overturning Roe v Wade, plus there is going to be a ruling on health care reform which I believe will uphold most if not all of the law.

The (D)s want to point out that women's rights are in danger as well as pointing out decisions like "Citizens United". There are also issues with Justice Thomas and his wife which can be brought into the debate.

Just like both sides want to run on taxes both sides want to run on Supreme Court appointments.

More specifically, the Democrats do not want to have this battle when replacing a liberal member of the bench.

If you do I will assume you do not want Obama to be re-elected and you would also be happy to lose the Senate.

I think that bringing this into focus will help motivate our base

The Supreme Court is fair game as far as the political debate is concerned and even if you don't want to fight this battle I think it is coming.

The health care reform decision will cause a fight no matter what it is. I think it is good for us to get out there and make our case for appointing justices that are not conservative idealogues.

I think we will hold the Senate. It does like we may lose a couple seats but the (R)s would need to pretty much run the board to take control and I just don't see that happening.

Remember Senator Biden's Circus with Clarence Thomas? These battles never gain us anything. But the Republicans always manage to make hay out of them. We suck at it.

But the Ginsburg replacement fight does not need to happen until Obama's second term. Or, do you think she should step down because she is female? Is it the right thing for a caring mother to do? Is that what you are thinking? Step down for the good of the the country... Be a good woman Ruth. Get out of the way.

I have been impressed with Kagan's writing, and she seems to vote liberally, too.

Do you have a link to a list of each of their voting records to evaluate?

show that they are hardly "liberal" especially when compared to the truly liberal justices of the past. Just saying they usually vote with the "liberal" bloc can be deceiving because the conservative bloc is so extremely right wing that any moderate would also vote against them in most cases. In three cases that matter most to me King, Davis and al-Kidd they voted right along with Scalia conservative/authoritarian bloc. Kagan also voted against a stay of execution for a retarded woman, Teresa Lewis. I'm not saying they are Roberts and Alito, but lets not kid ourselves that they are liberal.

If Ruth Bader Ginsburg retires, the Republicans will filibuster anyone President Obama nominates.

This Congress is so broken the president could nominate Monica Goodling and see the Repukes reject her as being too liberal.

Although some have speculated she might step down next year, the 77-year-old Ginsburg told The Associated Press on Tuesday she has no plans to retire anytime soon and still wants to match Justice Louis Brandeis, who stepped down at age 82.

SNIP
http://www.boston.com/news/nation/washington/articles/2010/08/03/ginsburg_says_no_plans_to_leave_supreme_court/

Justice Louis Brandeis was on the Supreme Court of the United States from June 1, 1916 – February 13, 1939 - 22 years, 8 months, 2 weeks
Justice Ginsburg has been on the Supreme Court since August 10, 1993.

So, if she wants to beat his tenure then she couldn't retire until the end of April 2016

That would still leave enough time for President Obama's to appoint a new justice and get him/her confirmed before he leaves office January 20, 2017.

She mentioned a painting that usually hangs in her office by the German emigre artist Josef Albers. The painting is part of a traveling exhibition and is supposed to be returned in 2012.

"If anyone asks how long I'll be here, at least until my Albers comes back," she said.
