will the SCOTUS we have now listen to the case or just let the haters win?

The SCOTUS chooses what cases they will hear. I have no clue whether they will choose to hear this one or not. With our current reactionary Court, I'm not sure I'd want them to hear it.

...and agree that it seems an unpredictable out come.

It's so angering that the whole thing was SO sleazy...and the cast of creepy characters/Mormons...and
then the court case and the hiding of the video...just plain skeezy.

3 rulings:

Is the judge bias: no
Is prop 8 constitutional: no

The biggest if is standing and 90% of people on both sides say its likely they do have standing.

It would be in any case I guess.

I wonder though if Prop 8 is ruled unconstitutional if people in CA will be able to marry or if there will be some kind of stay issued pending appeals. This could drag on or years. Ugh.

Its already been ruled unconstitutional, the 9th is expected to uphold that and stay it so the next court can hear the appeal. Or they could ask the 9th to rule en blanc (10 judge panel), then after that to the US Supreme Court. It could be less than a year, to 2-3 more years.
