Man gets 60 days in slapping death of daughter. Doesn't even have to serve them consecutively

The reason he gets such an easy ride is that the victims siblings say putting their father in jail for longer would harm the family.
That is really effed up.

Sidimé, 74, pleaded guilty to manslaughter after slapping his 13-year-old, Nouténé, so hard that an artery in her brain ruptured.


According to testimony in his 2011 preliminary hearing, Sidimé slapped his teenage daughter twice for not doing a chore in the manner he had instructed.

Apparently, the laws and sentencing for violent crimes are pretty lax in Canada.

One poster just told me that a passenger on a bus randomly chopped off the head

of another and Canadians were proud that he MIGHT get 9 years!

Freaking A, how would you feel with THAT guy walking around after 9 years?

I'll take our tough sentences for violent crime any day!

No, sorry, I don't think giving a sentence exceeding 60 days for killing your kid,

or one giving MORE than, rather than "at least" 9 years, for beheading a stranger,

can be called "draconian". If that's draconian, I'm all for it.

I recently got into an argument with another DUer over this. It's an extension of the belief that children are property. The consequences of punishment to a family never seem to get discussed much unless the victim is the child themselves. But then apparently they're supposed to suck it up and endure rather than be removed to safety.

... I know I have. I'm not forgiving this (I disagree with all corporal punishment), but I understand why they wouldn't throw the book at him. It could've been my parents, or my parents' parents, etc...

It's perfectly understandable, but it's yet another reason why justice isn't supposed to be based on what the victims want or need.

"...as hard as a 74 year old could muster." Although he didn't look like a large man in the photo, he might be stronger than a lot of 40 year-olds. Genetics, occupation, diet, and lifestyle might have provided him with a strong physique for his age.

Everyone I talked to about it was outraged and hoped he'd be shut up somewhere for a hell of a lot longer than that, either in a psychiatric hospital or prison.

It was an off topic subject that came up, and I found the majority were acting like nine years was a lifetime or something.

When the American posters suggested, you know, life....it was like "My God, no you can't do that, he only mentally ill. He'll get good treatment and be fine. You Americans don't have any answers other than lock 'em up and throw away the key"

he's fucking dangerous, and, yes, I'm sure a guy who goes on a bus and

chops off a stranger's head, will be "just fine" after nine years.

You should have asked them if they'd like to live next door to him when

he's released. .

I didn't realize their laws were so lax.

People may say US laws are too tough (and for non-violent crimes they often are) but

murder and mayhem?...Screw it, I'll take the strict route any day.

Punched, maybe. Hit in the head with a tire iron, sure. I am not sure that you can say that he intended to kill his daughter by slapping her twice. I would bet that he was extremely surprised that she died. I know a whole lot of parents who have slapped their teenaged kids and been slapped back by their teenaged kids and no one has ever gotten hurt.

Look at it this way. If this was two women in a fight, and one of the women slapped the other women---slapped, not punched, not hit over the head with a bottle--and somehow the slapped one died, would you think it appropriate to send the killer to jail for life? And the man is 74. Not 54. Not 34. This is an elderly man

It does say he slapped her hard enough so that it ruptured, the guy is a POS, 74 or not, and I'd be willing to be this wasn't the first time and won't be the last.

That's the clincher. I'm infuriated that just because he doesn't have a police record for violence that authorities assume he has never been violent. There is no way in hell that this was the first time he physically assault one of his kids.

It's been on the news here in Canada and listening to his family make excuses makes me want to vomit. 60 days is an insult. Guaranteed it wasn't the first time. Typical dysfunctional family - circle the wagons. ugh.

and that's what ruptured. But yes, it had to be one hell of a slap to do it.

I feel so sorry for the girl. Growing up in a family of screamers and face slappers is horrible. Growing up in a family where the older members hit the younger is worse. Growing up in a family where a full grown male feels entitled to hit children is by far the worst.

In criminal law, it is intent that matters most. The sentence might be "light" because there might not have been "intent to kill." True he intended an assault and that's horrible, but he did not intend to kill her, and that is worse. Has to punished as worse, no matter what happens.

He might not get Murder One here, probably Manslaughter 1 or 2, maybe

Reckless Endangerment or Criminal Negligence, but even those get more

than 60 days!..You'd get more time here for Loitering.

(Sounds like a lot more violence was involved than the word "slap" suggests. He admits two "slaps" and another blow to the backside.)

And you want to base an argument on his choice of words? I bet "slapping" is a euphemism for a fist. Sounds like violent child abuse. I have seen plenty of ugly, elderly men who are capable of physically violent offenses. Who is to say he did not use a weapon in his hand?? And the fact that an intra-cranial hemorrhage is extremely rare under light duress, and that's giving you the benefit of the doubt, because I think she would have to have a pre-existing condition to trigger her death, probably from this creep in a previous episode of abuse, should say to you that statistically, he is probably lying his sick ass off. Your next line contradicts you though "no one has ever gotten hurt."
Somehow you seem to avoid that conclusion in your own faulty argument.

I think it means he was acquainted with the abuse laws and/or investigation procedures. A slap to the head doesn't leave a visible bruise, therefore schools and CPS are less likely to get suspicious and investigate. (yes, unfortunately I knew someone who did this, and got away with it for years)

You'd be surprised how much force can go into an open handed slap.

To have him available to beat another of his kids to death? Didn't the death of this child irreparably harm the family?

This is not justice, the court should realize those kids have been brought up by fear and force and their statement cannot be taken as fact.

I would expect it to be the opposite - the same thing here would result in a longer sentence. Remember we have the greatest prison population of any country.
