Richmond: Family of man shot by police files lawsuit

The family of a Richmond man shot to death by police in September filed a federal wrongful death lawsuit Saturday, claiming the unarmed 24-year-old had his hands up and said "don't shoot" before the fatal shots were fired.

Civil rights attorney John Burris announced the suit Saturday along with the family of Richard "Pedie" Perez III outside Uncle Sam's liquor store, where Perez was killed Sept. 14.

The federal complaint seeks an unspecified amount of damages and names Wallace Jensen, the K-9 officer who shot Perez, among its defendants. Perez's mother and father are the plaintiffs.

"There is no justification for the use of deadly force if a person is surrendering," said prominent East Bay attorney Burris in a prepared statement released Friday. "Any suggestion that Perez was belligerent, uncooperative, and aggressive is simply an attempt by the defendants to demonize a young man that was well known and liked in his community."
