Justice Kennedy gives hope to advocates of online sales tax

Justice Kennedy gives hope to advocates of online sales tax
By Bernie Becker

Retail advocates got a boost this week from an unlikely source in their years-long battle to give states more power to collect sales taxes: the Supreme Court.

I understand the case for onlibe sales tax, but which state should collect -- buyer's or seller's? Why? And why online tax if print catalogues don't collect any (most don't unless company in same state as buyer)?

Cries of unfairness are empty of validity. If I'm buying from a company several hundred miles away, whose merch isn't sold in a store near me, there's not much unfair competition involved.

The Constitution forbids taxes levied on out-of-state goods, per Article I, Section 9.

No tax or duty shall be laid on articles exported from any state.
