Make no mistake: Gov. Chris Christie suffered a major defeat this week at the hands of the state Supreme Court. It was one of the greatest affirmations of the integrity of our judiciary in a long time.
The Christie administration was, in essence, telling our state's highest court not to hold by its own orders on affordable housing. The message of the justices was clear: No way.
They drew a red line in the face of our imperial governor, reiterating that towns can't use their zoning laws to keep out working class people. Most notably, the decision was unanimous. All three of Christie's appointees ruled against him, putting the law before politics.
The response from the governor's office was unusually muted. After all, what is Christie going to say now that his own people are activist judges? That this is yet another edict from a "liberal court"?

(1,644 posts)Many Repubs and conservatives I have talked to despise him. If he still has dreams of running for president, he needs to put them away. There is virtually no chance of him winning the Republican nomination. Most of them see him as a pal of President Obama.
Boehner, McConnel, and McCain are also on their shit list.

An appointed judge - if ethical - can give intellectually honest rulings without fear of losing his seat.

And that's only one example. Scalia, for instance, has publicly stated that he doesn't even read anything but RW newspapers anymore.

Here in Iowa that reich winger Vander Platts orchestrated having three of the Supreme Court judges that let teh gays get married ousted in 2010 after their turn came up for retention votes. He tried to do the same again in 2012 but that time the voters decided to retain the remaining judges who voted for marriage equality. I suppose he could try again in 2020 or 2022 but hopefully he'll get smacked down again by the voters.

(2,419 posts)before I even finish a cup of coffee on a Sunday morning, I believe this Supreme Court decision was exactly what Christie was after. He and his administration purposely caused it. They were deliberately failing to move forward with new acceptable affordable housing rules and policies in an attempt to get to this very point. The constitutional obligation (that's NJ's constitution) still exists with no mechanism to implement it. Now there is something of a free-for-all where Christie's supporters in the building industry (who were his prime supporters in getting him into office in the first place) now have an opening to operate in a manner that will free them of local zoning and planning restrictions. Now they have the opportunity to enlist the Courts-or the threat of litigation- to strong arm municipalities. The results will not be beneficial. Kevin Walsh did gain a victory here by exposing the dilatory tactics of the Christie administration when it comes to affordable housing policy, however it is just another step in Christie's ultimate goal to eliminate planning and regulation from land use policy in a state that desperately needs it. It's a great headline, but not exactly what it appears to be. There is quite a ways to go before this issue is played out, but it isn't exactly what the Star-Ledger has portrayed. This isn't a good thing for NJ for any number of reasons that are way too complex to go into here. This issue may have a happier ending, dependent upon what the next developments are, but based on recent history I'm not too optimistic.

(4,552 posts)Zoning is the ultimate rich man's scam to control the middle class. Republicans love zenning. My community and county in south eastern Pa are completely republican run. They control everything I do on my property. I can't dig a hole, cut down my trees, change my heating system or put on a new roof unless I ask permission from my local government. Funny thing is that most of my state has no zoning and everything runs just fine.
Zoning is completly out of control in my area.
When I point out that zoning is clearly socialism the republicans get real quiet. I thought republicans hated socialism?
