This story is poorly written; at any rate she received 6 years under the Feticide law, which will be served concurrently with 20 years of felony neglect. The case hinges on whether there was a living child that died after placed in the trash or not. She said that it was stillborn; initial doctor reports seemed to indicate it was still born, but the police brought in an "expert" who testified that it was born alive and subsequently died.

That makes very little sense - if the child was born alive, than the neglect applies. If the child was stillborn because she took pills she got from China (according to the Prosecution) than that was supposedly Feticide. Logically, how can it be both?

At any rate, it's a pretty terrible affront to justice anyway you read it. It sounds like she was railroaded.

I find myself wondering if a certain amount of her case was motivated by race - she's from India. That might have inhibited the jury and judges ability to empathize with her.
