DNA links former Chili's employee to spit in customer's drink

A couple has filed a lawsuit against a former Chili's server, the owner of the Clay, New York, franchise location, and Chili's parent company Brinker International, after DNA results prove that the server spit in a to-go drink.
Last July, Ken Yerdon explains to ABC News that he and his wife Julie Aluzzo complained to their server, Gregory Lamica, then 24 years old, that their "food was under-cooked and that they hadn't been served chips," while dining at the restaurant.
"We weren't rude or anything," Yerdon claims to ABC News. "It was a busy night but we didn't expect for our food to get spit in." After paying their bill and leaving a tip, the couple asked for to-go drinks.
Yerdon allegedly took two sips of his drink before the styrofoam cup's lid unexpectedly came off en-route to their home. "The lid popped off and I looked in and there was some spit in the cup," Yerdon shares with ABC News. "It was really bad."
