I'm really tired of the right's phrase "Legislating from the bench" bullshit

Whenever a court case is decided that the "right" doesn't like they claim that the judge or judges are "Legislating" from the bench. When in reality THAT IS EXACTLY WHAT THE FUCK THEY WANT THEM TO DO as long it is in THEIR favor Matter of fact most righties couldn't give a crap less about precedent or the Constitution as long as a judge rules in their favor of whatever subject.

We need to stop these assholes in their tracks when they say this garbage.

It's the judicial branch's job to legislate from the bench. Orsino Jun 2015 #10

The right calls it "upholding the Constitution" when it benefits them. Go figure.

as far as they were concerned. but let a ruling go against them, they start jumping up and down like two-year-old crying foul.

had SCOTUS gone the opposite way, there's no way they'd be complaining about that. They'd be extolling the virtues and wisdom of SCOTUS. We'd be grousing about a negative decision, albeit for different reasons. It was a stupid lawsuit that really should never have seen the light of day at SCOTUS though I guess I'm glad that it has been reviewed and settled once and for all. When I first heard about the lawsuit, I became worried, particularly when a federal appeals court had ruled in favor of the plaintiffs and moreso when SCOTUS agreed to take up the case but at least it's definitely settled now and the Republicans, whom never had a viable plan fix things if SCOTUS ruled for the plaintiffs, can go back to their wailing and teeth gnashing.

and paid attention knows it.

If litigants have standing and the case is justiciable, a court is REQUIRED to issue a ruling.

Saying anything else is a fog of greasy smoke and cracked mirrors.

"Conservatives are wondering how this could have happened, with some saying Roberts has betrayed the cause. "

As if that doesn't boggle the mind?

The right doesn't care if the Judges use a finger in the wind and astrology to come up with their decision...as long as it is THEIR beliefs that are being upheld. If it goes against their beliefs it is "Legislating from the bench, anti-Constitution, anti-American...blah blah blah."
