Gov. Gary Herbert said Thursday he is "puzzled" by a Price judge's decision to order a lesbian couple to give up their foster child and said he expects state agencies and the courts to investigate the matter.
"I'm a little puzzled by the action down there, personally," Herbert said during his monthly KUED news conference. " The judge) may not like the law, but he should follow the law.
We don't want to have activism on the bench in any way, shape or form."
... Herbert said Thursday that the state's Division of Child and Family Services will review the judge's ruling which has yet to be released and investigate the matter before deciding how to respond. And he said other courts will certainly review Johansen's decision.
"I expect this will be under review," Herbert said.

(14,400 posts)He's a puke, the judge is likely a puke. Republicans don't want to shit where they eat anymore than dogs do so he's trying to not blatantly piss off the judge yet still tell him that he's going to be overturned.

(54,387 posts)Clever move, saying he is against all judicial activism, and thus this, too. This actually WAS a case of judicial activism, and it must have pained him to come out against a ruling conforming with his own views. However, if he condones this, he can't whine about similar rulings with a progressive bent coming from courts far higher up (as in Supreme, e.g.).
