Police officer shoots man climbing out of wrecked car. No charge.

The Paradise police officer who investigators say accidentally shot a suspected DUI driver in the neck last month will not face criminal charges, Butte County District Attorney Mike Ramsey announced Thursday.

Paradise Police Officer Patrick Feaster, a five year veteran of the department, was parked on the Skyway around midnight Thanksgiving morning, when he saw a Toyota Four-Runner speeding out of the Canteena Bar parking lot without headlights on.

Feaster followed in his patrol car, as the Toyota ran a red light and turned onto Pearson Road where the driver, 26-year-old Andrew Thomas struck the median and flipped, ejecting his 23-year-old wife Darien Ehorn from the vehicle. Ehorn was killed in the crash.

Ramsey said Feaster drew his gun when Thomas “popped” out of the car, believing he would flee. As Officer Feaster moved towards Thomas, the gun discharged and struck Thomas in the neck. The shot hit Thomas in the C7 and T1 vertebrae and could lead to him being paralyzed for life.

According to Ramsey, several factors led investigators to believe the shooting was accidental. “The dash cam video shows Officer Feaster was not prepared for and was surprised by the guns firing. The pistol discharges in mid-stride and the officer both flinches his head to the right and does a stutter step indicative of an officer not prepared for nor intentionally firing his pistol. Additionally, officers normally train to fire a minimum of two shots. There was no second shot and the officer immediately holstered his weapon after the discharge.”


I'm no expert, but it looks like two shots to me. Regardless, the justification for the shooting is spurious in the extreme.

The only thing that is correct about the "description" of the video is the cop didn't stand still when he shot. But he didn't stutter step or act surprised at all. The cop looks about as natural as anyone taking a walk down the street, shoots twice as soon as the guy gets up, dropping the guy instantly back down into the car, then he puts his gun away since he doesn't have line of sight to shoot him more.

It honestly looks like this cop would rather kill someone than arrest them. Free paid vacation timeout for a while so he can eat more and get in worse shape. I know asking for justice is just way too damn much... but is asking for cops to at least have mandatory fitness requirements too much as well?

How the hell does a trained person have a gun go off unintentionally? I can see that happening tto "Joe Schmoe" but NOT sommepne who has been trained in the use & handling of firearms, and continually practice shoots .

Firearm police use is the glock, it has no safety, if it is chambered all it takes is a pull of the trigger so he very well may have been surprised but he should never have even had his finger on the trigger. With a glock it is always bad idea to have a finger inserted unless you are prepared to fire..

So I am pretty well aware of that safety feature but it is designed with the purpose of preventing discharge if the gun is dropped not if accidentally pulling the trigger, no conscious act of remembering to take the safety off which is good only up to a point...

The only real safety is your finger.

But there are a lot of them out there....I would bet that at least half and probably more of the gun "accidents" involve glocks because of poor training or total lack thereof.

The shooter is only worried about finding his casings.

And the cop wasn't fired for trying to cover up his shooting? He only fesses up when they are sending someone back to the bar to see who shot the guy?

Officer didn't even pause for one second, just walked up and shot the guy, then called in that he had an "unresponsive" suspect. WTF? Maybe he would have been responsive if Officer Triggerhappy hadn't shot the guy in the neck!

...why are these shooter cops FAT? Doesn't that deserve some questioning? This guy couldn't run down a sloth. When you're in terrible shape, the only recourse is to SHOOT. You have no way in hell of running down a suspect.

I know many of you will post-shame me for stating the obvious. But why do we allow 350 pound cops?
