I think the ban is totally stupid--there is a difference between the 2003 ban on smoking in bars, where non-smokers might like to breathe too, and restrictions on the amount of soda a person is allowed to buy in a cup. The author seems to be saying that "'living in a free country' is supposed to mean" that our elected representatives can micromanage our lives if we are the ones who elected them. 
Of course, in the previous paragraph, he also says that we don't live in a free country and never have and never will, so I guess the entire article constitutes a pretty weak argument.
I will grant you that this rant, having utterly failed as a logical argument, does work equally (un)well for cigarettes, guns, and gas-guzzling cars! Bravo!
The logic (if you want to call it that) behind this rant was essentially this: since you're not allowed to commit murder, stop complaining about Big Gulps being illegal.
Note that he thinks it applies equally to guns, cigarettes, and cars that don't meet his fuel economy standards...if he doesn't like it, ban it!

Most of the folks who are complaining don't come from or understand NY, nor do they comprehend that this law is just one piece of a larger plan that also provides money for free fitness sessions and support for financially-strapped people who want to buy nutritious local food at farmers' markets.
They haven't seen the impact of diabetes on the NY population, and the drain on the city's resources, not to mention the suffering that comes with the disease.
Expect these reflux threads for some time to come as the soda industry fights back. And, yes, I'm a person who enjoys a Pepsi and a slice. I'm no teetotaler.
I'm so proud of NYC. We are the place that suffered the worst attack on American soil, worked hard to build our economy and promote diversity, and now attracts young people from all over the world who come here on creative pilgrimages.
We're a city that is building bike lanes, installing bicycle rentals all over the place and turning a large part of our concrete space green again. Our energy company is working on serious plans to build our alternative energy sources. We would have been able to clear much of our smog, keep subway fares down and enhance our public transportation if the goobers who populate our state houses hadn't voted our transportation plan down. In the meantime, their local corruption strangles their regions, but I am digressing...
In summers, our parks, large and small, are awash with music, film and dance, much of it either free or available for a donation under $5.
I could go on and on. The bottom line is that NY is both a pragmatic and an innovative city. The folks who perpetually complain about one law think that the elephant's tail is the elephant.
So, no, you're not alone. You are just the lucky one who got a rant in reply because I agree with you. 
Don't think other people are complaining either...

It amazes me that you cannot ask for a small soda at fast food restaurants---the smallest is a medium. Huh??? And medium is larger than a large in my younger days. And those super sizes----OMG, who can even drink that much???
We are now down to really only 2 groups..overweight people and smokers.
