Trump’s personal, racially tinged attacks on federal judge alarm legal experts

By Jose A. DelReal and Katie Zezima, June 1, 2016 Washington Post

Donald Trump’s highly personal, racially tinged attacks on a federal judge overseeing a pair of lawsuits against him have set off a wave of alarm among legal experts, who worry that the Republican presidential candidate’s vendetta signals a remarkable disregard for judicial independence. That attitude, many argue, could carry constitutional implications if Trump becomes president.

U.S. District Judge Gonzalo Curiel, who is handling two class-action lawsuits against Trump University in San Diego, has emerged as a central target for Trump and his supporters in recent weeks. The enmity only escalated after Curiel ordered the release of embarrassing internal documents detailing predatory marketing practices at the for-profit educational venture; that case is set to go to trial after the November election.

“I have a judge who is a hater of Donald Trump, a hater. He’s a hater,” Trump said at a campaign rally in San Diego, adding that he believed the Indiana-born judge was “Mexican.”

He also suggested taking action against the judge after the election: “They ought to look into Judge Curiel, because what Judge Curiel is doing is a total disgrace. Okay? But we will come back in November. Wouldn’t that be wild if I am president and come back and do a civil case? Where everybody likes it. Okay. This is called life, folks.”

He's talking about filing a lawsuit, naming the judge as a defendant ... Perhaps, Don D. Con should have one of his great, fantastic, bestest lawyers on the planet, look up the case law on Judicial Immunity.

Why isn't the media all over this? Never mind.

he represents all that has gone wrong in an American educational system that, for decades, has de-emphasized critical thinking, while placing all importance in checking the box that "they" tell you to (again, without thinking about why you are checking that box ... beyond because you are told it's the correct answer, or thinking about the likely consequence(s) of your checking that box).

One of my fears is that everyone I know doesn't come close to the millions of fucking idiots who think this guy is going to fight for them, give a rat's ass about them, do anything for them or anyone other than himself if he wins.

Eventually, the collective laziness and stupidity that have become nearly virtuous in this culture are going to manifest themselves in something tangible that affects everyone. A Drumpf presidency would be a lot of chickens coming home to roost with a vengeance.

I don't want to turn this thread in this direction, but this is why I don't get the Bernie-or-Bust folks: I'm a Bernie supporter but if it winds up being HRC, are you REALLY going to stay home and pout and give this scumbag an opportunity to completely ruin this country? I wouldn't be EXCITED to vote for HRC by any means, but I'd be TERRIFIED to do anything but if those are our two choices.

When a person files numerous baseless lawsuits, they may be called a "vexatious litigator" and be prevented from filing similar suits in the future.

The remedy for such a lawsuit is called a "summary judgment" which means the Court finds no cause of action in the petition, no issue at law, so it gets dismissed.

He wants to sue the judge? For what? "Ruling against you" is not a recognized cause of action in any sort of court.

The dumbass has no idea that events in courtrooms are almost always covered by privilege and you can't sue about what is said or done in court.

Thing is, you think he'd know a lawyer from all the times he's sued other people. They'd tell him that.
