Jared Fogle, the disgraced former Subway pitchman who is in prison on child pornography charges, is reportedly looking to sue the parents of one of his victims.
Parents of the underage girl had sued Fogle earlier this year, saying that their daughter became suicidal after learning that she was one of several minors who were unknowingly filmed while changing clothes or bathing. Fogle was sentenced to prison for 15-and-a-half years in November.
According to NBC News, Fogles lawyers on Thursday filed a motion stating that the girls parents divorce was the root of her psychological damage, charging that their hateful and abusive relationship toward each other contributed to her distress.
This included, but was not limited to, engaging in frequent fighting and arguing between themselves; abusing alcohol and getting drunk; and engaging in frequent fighting, physical abuse, and arguing with Jane Doe, Fogles attorneys stated, according to the Daily Mail.
Fogles attorneys also said that the parents custody arrangement caused unnecessary stress, anxiety, and trauma for the girl.

What I don't understand is how he could use this premise for his own original civil lawsuit where the parents could end up compensating him for *his* distress.

Fogle is a defendant in the case filed by Jane Doe, the victim in question.
Fogle has moved to file what is called a "Third Party Complaint" essentially pleading that Jane Doe's parents are the primary cause of her emotional distress, and to join them as defendants in the case.
He is not looking to "sue" anyone or to recover damages from anyone.

Fogle has moved to file a "Third Party Complaint" which is essentially a mechanism to include Jane Doe's parents as defendants in the case, alleging that they are a cause of her alleged emotional distress.
Dynamically, there are a couple of things going on here.
Jane Doe is apparently a minor and the parents are not parties to the suit, although the suit was initiated by her parents on her behalf. However, what some parents don't realize about this situation is that once the minor has an attorney, that attorney is not working for the parents. That attorney's duty is to the child. It doesn't matter what is the fee basis or who is signing the check. It is perfectly fine for you to hire a lawyer for someone else. But once you do that, you don't get to control the course of litigation.
