... His lawyers cite U.S. District Judge Anna J. Brown's order that the ownership of the Malheur National Wildlife Refuge is not on trial in this case, and her judicial notice to jurors that the federal government owns the bird sanctuary in eastern Oregon.
They also cite the judge's ruling preventing Bundy's lawyers from discussing Bundy's contention that he took over the refuge to stake claim to the property through the principle of adverse possession. Bundy is allowed to talk about his intent if he takes the witness stand ...
Philpot, in an accompanying declaration, contends his client has not been able to consult with his lawyers during trial breaks, hasn't had access to pens for note-taking and hasn't had enough to eat during trial ...
As Bundy's appeals await rulings by the 9th U.S. Circuit Court of Appeals, the court is expected to continue Thursday with testimony from the Rev. Franklin Graham, Harney County Sheriff Dave Ward and possibly Bundy as well ...

Since he's a rightwing nutjob, I might suspect he'll be testifying along the lines that the armed occupiers, who were trying to seize the refuge from Federal control, had no idea that their actions might intimidate Federal employees, or prevent them from doing their jobs, and that the occupiers were discharging guns there only as an expression of their deeply sincere understanding of the Bible

PORTLAND, Ore. (KOIN) Rev. Franklin Graham, who came to the refuge with Nevada legislator Michele Fiore to help the final occupiers surrender, testified first thing Thursday morning in the Malheur Wildlife Refuge trial ...
When Rev. Graham took the stand, he testified the FBI asked him to call the 4 remaining occupiers Jeff Banta, Sean and Sandy Anderson and David Fry after a specific request Banta made.
I wanted to help calm the situation, calm them, but also wanted the FBI to take a deep breath, Graham said in court Thursday.
He added they had normal conversations about food and weather with them. The Andersons, he said, were different and had strong personalities ...

... Graham said he spoke to the occupiers every day until the takeover ended except for one day when he was traveling because he wanted to save lives. His powerful testimony offered a glimpse into the mindset of the four occupiers in the final days.
He said the occupiers were afraid to give themselves up to the FBI, especially after the shooting of Robert LaVoy Finicum.
Graham described the nature of his calls and how it worked: He would always call the FBI before he would call the occupiers directly. Then he would check back in with the FBI after each call ...
Graham said Jeff Banta was the first person to come out, but Banta later testified that he was the third person to emerge, following Sean and Sandy Anderson. Graham said the Andersons came out with their hands up holding an American flag. After those three came out, the FBI drove the BearCat back a bit, where he said he was able to meet those three, embrace them and tell them, You did the right thing ...

... Among other things, attorneys Marcus Mumford and J. Morgan Philpot have taken issue with U.S. District Court Judge Anna Brown's order that the ownership of the Malheur National Wildlife Refuge is not on trial, and her notice to jurors that the federal government owns the refuge that Bundy and his followers occupied for 41 days last winter.
Philpot, in a separate court document, reiterated a longstanding argument that Bundy's pretrial detention has hindered his defense.
He also lodged complaints about the government's treatment of his client during the trial, saying U.S. marshals have not allowed Bundy to confer with attorneys during breaks and that Bundy has been denied the use of "normal" pens, paper and amounts of paper ...
