NJ Woman Hit by Ball Sues Little Leaguer

MANCHESTER TOWNSHIP, N.J. - A New Jersey woman who was struck in the face with a baseball at a Little League game is suing the young catcher who threw it.

Elizabeth Lloyd is seeking more than $150,000 in damages to cover medical costs stemming from the incident at a Manchester Little League game two years ago. She's also seeking an undefined amount for pain and suffering.

Lloyd was sitting at a picnic table near a fenced-in bullpen when she was hit with the ball.

Catcher Matthew Migliaccio was 11 years old at the time and was warming up a pitcher.

Matthew's father, Bob Migliaccio, said they were concerned for Lloyd when it happened. Then his son started receiving threatening and nasty letters, he said, and he started getting angry.

"The whole thing has almost been surreal," Migliaccio said. "We keep thinking it's just going to go away, and then a week and a half ago a sheriff shows up at my door to serve my son the papers."

to the signs that used to be numerous and clearly written that balls and bats can hit people watching and you are watching at your own risk????

Back it the 60's when I played LL it was the norm and in every ball field I played at.

Heck I have been to 12 different Major League Parks and 3 Minor League Parks and the ALL had similar signage.

I am that old and out of touch now??????

there was a similar case a few months ago. As long as the park has warning signs up and the act wasn't intentional, it will probably get thrown out

Somebody could have gone full steam and beaten that poor kid with a belt while screaming about what a "stupid little careless brat" he was(in their eyes, of course, not that the kid did anything wrong in this case), etc. Sadly, there are still people like that out there.

In any case, I do feel a little sorry for the lady(being hit with a baseball can really hurt), but she shouldn't have sued this kid, who's just 13 years old now. No excuses for that. None.

But the sad thing is this is what happens when you concentrate a superpowers' wealth into the hands of very few - people get desperate and start taking out their frustrations out on those that don't deserve it - like this kid. This should not happen in any civilized society but when people get desperate that's when crap like this happens.

If her nose was broken, or if she had any facial injuries, she has every right to sue for medical compensation.

Every Major and minor league stadium I've gone to has both signs at the park and notices on the tickets that warn you to look out for balls and bats. If fans could sue, baseball teams would cease to exist because balls enter fan areas all the time, EVERY. SINGLE. GAME. Teams would be sued for every penny they had.

Whether or not this will some day happen on the Major League Level? Yes MLB ballparks have signs, and people who come into ball parks will probably read them, its probably listed on the tickets, when sold, but there will always be that one or two persons who want to sue a Major League Player, or Team for that matter.

Is a major suit a few pitches away?

I hope the case is thrown out and that the woman is ostracized by her friends and associates.

... is just desperate to have her medical bills payed. It's cruel to sue the child. She must have some motive.
