(32,017 posts)All three branches have an equal responsibility to ensure what they are doing is constitutional. If there is a dispute then ultimately the judicial branch makes a ruling assuming they have the jurisdiction to do so. Congress has full authority to not allow the judicial branch to rule on a law it passes. Not often done but the Constitution gives them that right.

So I don't see what the fuck difference it would make whether he did or did not win the popular vote.
