A senior White House adviser on Sunday denounced federal judges who have stood in the way of Donald Trumps controversial travel ban, warning that the whole world will soon see that the presidents executive powers will not be questioned.
We have a judiciary that has taken far too much power and become in many cases a supreme branch of government, said Stephen Miller, a senior adviser to Trump on immigration issues, appearing on the CBS program Face the Nation.
Our opponents, the media and the whole world will soon see as we begin to take further actions, that the powers of the president to protect our country are very substantial and will not be questioned.
At the same time, Miller signaled that the White House is contemplating a new, narrower executive order to impose its travel ban on refugees and travellers from seven Muslim-majority countries, after a federal appeals panel seemed to suggest that a revised ban could pass legal scrutiny. (146,317 posts)Stephen Miller is just a kid. He doesn't know much, really, but he's the only one left to send out to talk to the media. Kellyanne's a laughing-stock, Bannon is too freaking frightening, and Spicer has to have a podium in front of him to hide the fact that he has peed his pants in fear of angering Drumpf.

(11,738 posts)Yes, the president has broad authority with regards to immigration and national security issues, but that does not stop parties aggrieved from having legal recourse. The administration was sued, in court, by plaintiffs who said they had been damaged by the order. The Court, doing its CONSTITUTIONALLY mandated duty, reviewed the compliant, made a bench ruling pending further review, then heard arguments from both sides, then they ruled again pending further review. That is what courts do. That is all they do. They review, based on law and legal precedence, whether policies are within the boundaries of the constitution and are thus valid or not.
Trump and his sycophants are having a tantrum about it. Every president has been struck down at some point, by the court stating that a particular action, or piece of policy did not pass legal muster. They move on or they amend the policy to bring it inline with the ruling. They don't whine about how the court is somehow illegitimate or get all dictatorial.
