I'm not sure about this because I don't represent defendants, but I think Fox News would be on solid ground in saying that settling a lawsuit was part of its business, so the amount paid to the plaintiff, as well as the fees paid to the corporation's attorney, would be tax deductible. IIRC there's a specific exclusion for amounts paid in punitive damages, which are not deductible. If Fox settled all of Falafel Boy's cases without going to trial, however, there wouldn't be any punitive damages.
