Did the Obama Admin reapprove Flynn's clearance in 2016?

Spice just claimed this, if I recall statements from yesterday that was NOT the case. Off to do research.

The House oversight panel is asking for the documents by April 3.

Chaffetz and Cummings are requesting “that each agency produce documents relating to Flynn’s foreign contacts and payments, security clearance applications, and other related documents between the time of his retirement in 2014 to present day,” according to a committee statement.

WH stonewalling on docs..actually refused to give docs....

3. No. He may have applied for an interim clearance, but since he had already been removed...

I doubt he would have received one, especially since he wasn't working on any government project - except for the Trump Campaign - in 2016.
Now, the Trump campaign may have asked for him to get a clearance, but I'm pretty sure it would have been very limited. Maybe Secret, but I doubt it would have gotten as high as TS-SCI, especially if the FBI was already flagging him.

4. This is what they are looking for..the SC (security clearance application) -

For now, Flynn lied - on application..that he has been removed is clear..

Who gave the clearance? - remember when he sat in on security briefings..WH is stonewalling investigation..

7. My guess is

Flynn was allowed to see classified information without a security clearance. The WH probably figured they could get away without asking for a security clearance, as a request for one for Flynn would probably be denied.

Flynn was allowed to see classified information without a security clearance - this doesn't even make sense...you do not get classified info w/o a security clearance....

... you were assuming that this WH is competent and considers such security rules and safeguards to be an important function of government. They do not. It is entirely possible - and I wouldn't be at all surprised - that Flynn was NOT cleared when he was shown classified material.

The dysfunction and outright malfeasance in this administration is off the charts.

8. It doesn't matter.

He may have re-upped, but if he withheld info on foreign contacts and income, he is culpable. Not the DoD, and certainly not the CiC.

Beyond clearance, it was the Trump administration's responsibility to vet him. They either failed to do so, or appointed him despite (or because of) his extracurricular activities. In that case, the CiC is culpable.

BTW, has anyone asked if he paid income taxes on his ill-gotten revenue?

9. Transition teams often aren't vetted too harshly.

Plus if problems are found they are reported to the head of security for the transition team. I worked on Yankee White case designations as they were known during gwb's transition and that's how it went.

On April 30, 2014, Flynn announced his retirement effective later that year, about a year earlier than he had been scheduled to leave his position. He was reportedly effectively forced out of the DIA after clashing with superiors over his allegedly chaotic management style and vision for the agency.[23][24][25][26] In a private e-mail that was leaked online, Colin Powell said that he had heard in the DIA (apparently from later DIA director Vincent R. Stewart) that Flynn got fired because he was "abusive with staff, didn't listen, worked against policy, bad management, etc."[25] According to The New York Times, Flynn exhibited a loose relationship with facts, leading his subordinates to refer to Flynn's repeated dubious assertions as "Flynn facts".

18. Generals are subject to be called up in case of national emergencies

especially in their first 5 years of retirement and when they are not over 60 years old. This is reason that retired Generals are not supposed to have any conflicts of interest taking foreign money or being foreign agents, without reporting and being approved.

A commission is for life. If an officer leaves the service or retires they still hold that commission unless they specifically apply to resign it. As such they are always subject to recall.

16. Experts on MSNBC said his last security clearance was January 2016

this was before Trump campaign and before Flynn took money from foreign entities so Trump Admin should have taken action for a new security clearance to be effective January 2017, which they apparently did not do. So Trump Admin failed to properly vet him.

20. What was done will depend on when his last military one was updated

 

Active clearance= you have a cleanrace and are in a job requiring one, so you are eligible to access classified information.

Current/inactive= you have had the investigation done and are still within the window of eligibility but are not currently in a job that requires a clearance. So while you meet all other requirements and your last investigation is still valid you can't access classified information because your not in a position requiring access. Sometimes a position requiring access is as simple as holding a specific rank that blanket requires it. So if you retire it goes current/inactive

Lapsed/experied= start over from scratch if you want a cleanrce again. If your current/inactive clearance goes 24 months without reinstatement, or you hit the mandatory renewal date first, your clearance is lapsed.

So who approved a cleanrace will depend on a lot of things. If he left the service with a fairly recent reinvestigation/renewal then barring going to a new position that required a cleanrace his clearance would be listed as current/inactive for up to 24 months and eligible for reinstatement without a new investigation.

I am seeing his retirement date listed as August 2014, but I am not clear if that was his date he left the position or his actual effective retirement date from the service. It can take anywhere from a few weeks to a couple months to process out as a retirement, then you are still on terminal leave until any leave you have accumulated is done. So it's possible that he could have not officially retired until mid November which would leave him eligible for reinstatement without a new investigation if the transition team requested it.

If he did have to renew and didn't disclose all those contacts it's a definite problem for him. And I wouldn't want to be the OPM investigator who handled it either.

They keep them independent so people can't influence the decisions, and I imagine they viewed him as a civilian at that point so didn't care.
