Do we have to do this again ? The difference between use of power and abuse of power.

I have seen some conservative legal scholars argue that the firing of Comey was within POTUS' legitimate exercise of his Article ll powers as his powers to hire and fire are virtually plenary. This is an absurd reading of the law. The operative word is virtually.

The president could have fired Comey for a host of reasons. That's why virtually is the operative word. He couldn't fire Comey in an investigation where he is a subject of or where he thought he was the subject of. That's where the obstruction of justice comes in.

BTW Obstruction Of Justice was in the first article of impeachment against Richard Nixon for asking the CIA to kill an FBI investigation into the Watergate break in.
