Flipping flop?

Scenario: The contractor came in and began implementing the redesign. Problem is, what he’s done so far is not in the contracted plan, and some of it weakens the entire structure. We’re told that even if his contract is proven invalid and we discharge him, the degrading structure he has already created must be allowed to remain.

Question: Do we really have no legal way to mitigate the damage he has done?

I would take a look at contractor and/or construction laws in your state because liability can vary. Same goes for what is legally defined as negligence. Also consider how big the contractor is. Is this an individual contractor or a larger business? That will influence how much leverage they have. Also what building codes were needed in order to implement the design? Good luck.
