Roy Moore Cast The Sole Vote In Favor Of A Man Who Raped A Four-Year-Old

The Alabama Supreme Court had the opportunity to hear the case of one Eric Lemont Higdon, a man accused and convicted of two sodomy charges due to sexual assault against a four-year-old at Mama’s Place Christian Academy in Clay, Alabama.

One of those convictions was first-degree sodomy of a child less than 12 years old. The other conviction was first-degree sodomy by forcible compulsion. Essentially, the first conviction was for statutory rape; the second for forcible rape. Higdon’s conviction on the forcible rape charge was eventually overturned on appeal. The state, by way of prosecutor Luther Strange, appealed that decision and the Alabama Supreme Court took the case up for review.

Eight of the nine justices on the panel found that the appeals court had erred. Their legal logic was such that a 17-year-old’s sexual assault of a four-year-old was enough to produce in the mind of the four-year-old, an “implied threat of serious physical injury.” The decision was reversed and remanded and Higdon’s conviction was reinstated.

Roy Moore dissented from that opinion. He wrote:

Because there was no evidence in this case of an implied threat of serious physical injury…or of an implied threat of death, Higdon cannot be convicted of sodomy in the first degree “by forcible compulsion.”

The reps here have made a meme with a pic of Doug Jones holding a fake sign that says "I want to put MEN into LITTLE GIRL'S RESTROOMS #DemPedophiles"
So I reported this to facebook where they are spreading this and facebook would not remove it. They said that it did not violate their rules. Imagine my surprise when their own candidate is a pedophile, lol. I sure wish I could be a fly on the wall where these jerks live.

They rejected the prosecutor in this case in the primary. How low can you go, they could have at least gone with an R that opposes child rape.

I do not have experience in what the popular social media outlets are in AL. Do any DUers?

Moore is a sleaze so it would be nice for this article to get some exposure in AL.

I would expect a good list of web sites frequented by a majority of Alabamans could be found here: www.splcenter.org/hatewatch Seriously, somewhat, the Birmingham News site at al.com would seem to indicate that the cretins do weigh in there to let those smarty-pants folks in Birmingham know they're not better than everyone else. So they're at least looking at that site. You're dealing with people who are impervious to facts.

Here is a good idea...

Let's put him in the United States Senate.

Dumbed-down... I wish.... this is pre-neanderthal.... pre-hunter/gatherer lizard brained stupid.

No fore-thought.... No hind-sight... the only motivations are exclusively driven by pure satisfaction of achieving an animal's most basic, raw, and often gruesome instincts. One hopes we have advanced beyond that - but don't be too sure.

What is up next for the Republican party... championing human flesh eating cannibalism - well done with loads of ketchup - all washed down with a tall glass of French champagne ?

Blind loyalty to their party and their cause - while methodically and cheerfully constructing a Theocratic Fascist State - as they proceed to dismantle Democracy.

How did tiny gun roy boy reach the conclusion that sodomizing a 4-year old didn't imply the threat of serious physical injury? It makes absolutely no sense whatsoever? He is a sick man who did god-knows-what to little kids when he was in Vietnam.

It is my understanding that Luther Strange brought this up during the primary, but most of the GOP voters still went with Moore.

I would hope that some of them are thinking back to that and realizing that it exposed more about Moore than they realized at the time.

But again, these are hard-core Republicans, so that would require more thought than they are capable of summoning.
