Oklahoma Creek tribe renews lawsuit against Alabama tribe over Wetumpka casino
An Oklahoma Creek tribe on Wednesday filed a federal court motion to a renew a lawsuit against the Poarch Band of Creek Indians over allegations that the Alabama tribe disturbed an ancestral burial.
The Muscogee Nation filed its original lawsuit in 2012, but the court case was stayed early last year amid potential settlement talks.
Muscogee Chief James Floyd said it successfully settled with other parties involved in the lawsuit, but settlement talks with the Poarch Creek Band were not "beneficial" and reached an impasse last fall. Floyd said further evidence in the case also surfaced in settlement talks with other parties.
According to court filings, the Wetumpka land, which the Muscogee Nation called Hickory Ground, was the last tribal capital in the 19th century before members of the tribe were forcibly relocated to western territory. Members of the tribe re-established the Hickory Ground Tribal Town in Oklahoma.
