Union ‘Fair Share’ Dues Issue Evolving Into Lisa Madigan Vs. Gov. Rauner Legal Battle

CHICAGO (STMW) Illinois Attorney General Lisa Madigan moved Monday to dismiss a federal lawsuit Gov. Bruce Rauner authorized that challenges fair share fees collected by labor unions in the state.
Madigan also filed to intervene in the federal action, saying she would defend the constitutionality of Illinois law.
The law allows unions to collect the fees even from people who are not union members under the theory that they benefit from collective-bargaining agreements.
I have submitted a motion to dismiss the case, arguing that the governor does not have the legal authority . . . to challenge the law in federal court, Madigan said in a statement. As attorney general, it is my job to represent the state and defend our laws when their constitutionality is challenged in court. Because the governors case questions the validity of the Illinois Public Labor Relations Act, I moved to intervene to provide the court with arguments regarding the laws constitutionality.

I weep for our state and what Illinois is doing to its state. And all the other states that have fallen into the hands of the oligarchs. We will all be poorer, less free, and sicker because of it.
An AG would have a much tougher time arguing that the legislature and governor don't have the authority to change state law (compared to this more reasonable claim that the governor can't act as AG).

Oh wait, that has already happened.
We may have made held some ground against Herr Walker had Van Hollen not been at the helm. But when you live in this nutbag's state, it's easy to grasp at straws. Republicans for everyone...a good share of DU feels we deserve what we get anyway.

very charismatic, as well. she has flirted w a run for gov. her old man is mike madigan, king of the ill leg. he is a little napoleon. an asshole who rulers w an iron hand. he is her only big liability. she can only win if he retires.

(750 posts)Its interesting to know how millionaire political people are after champagne pledges, especially those that make the claim to run the government like a business.
Usually on the mainstream media breaking news about small to major companies give a projection about money assets liabilities revenue in a timely basis. That includes lay off projections that could go into the future by many years. Or Union associated business conflicts of interest.
From my view state and federal employees are constantly dealing with predatory management practices especially by newly elected political practitioners, like Rauner willingly through deception by lying with all the intentions show everyone he is out to game the system.
Rauner has kicked his ideals to the top with his intentions to clip money from the Unions. As much as Walker with very inspired intentions to create legislation which directly abuses the basic construction of not only free enterprise but violates first amendment right in both the National and State Constitutions.
Rauner and Walker are a duet of condemning actions, feels like the saddle-bag politics of George Bush.
Rather than seeking to make or become better, with good faith to ameliorate America, the electorate gets this same Republican Paradox a detailed plan for a journey that blames and burdens the worker.
For Walker, a right to work is a law
then the job must be there
a living wage job.
For Rauner, those employees that opt out of paying dues are opting out of a basic raise. Rauner offers fools gold.
