Trump files $500 million lawsuit as pageant woes mount

NEW YORK (AP) — As fallout built over Donald Trump's remarks about immigrants from Mexico, the Republican presidential candidate answered back with legal action to match his trademark brashness, filing a $500 million lawsuit.

The suit against Univision for dropping the Miss USA and Miss Universe pageants claims breach of contract, defamation and First Amendment violations, and contends Univision turned on him because it supports Democrat Hillary Rodham Clinton for president.

In a statement, Univision called Trump's lawsuit "factually false and legally ridiculous." It said it will "continue to fight against Mr. Trump's ongoing efforts to run away from the derogatory comments he made."

Univision, which moved last week to opt out of Trump's pageants because of the celebrity businessman's remarks earlier this month, is now far from alone.

I can only hope that complete destruction of the Republican Party is at hand. Progressives are at long last fighting back against these repulsive scumbags. It is difficult to feel sorry for some racist, corporate boot lickers when they get a pink slip. Its a shame that they have to take down Democratic fellow workers with their folly.

The First is about what the government may do but you'd be surprised how many people think it governs interactions between private citizens. Trump is suing on a First Amendment claim, which is why I think Univision should countersue on the same grounds. Both should then be thrown out of court.

The Complaint mentions the first amendment but doesn't attempt to state a legal claim based on any infringement of his first amendment rights -- its a garden variety business dispute -- breach of contract, interference with business relationships and defamation claim.

Those media corporations are the very types of "private" entities that he loves.

The lawsuit is without merit. That or they counter sue for damages as he made hate speech about their customers.

According to the complaint, Univision planned to pay out in full the $13.5 million value of its five-year contract with Miss Universe Organization. The deal called for Univision to pay a license fee of $2.5 million a year for the first three years, and $3 million a year for the final two years of the contract.

It's a garden variety breach of contract, breach of covenant of good faith and fair dealing, intentional interference with business relationships and defamation lawsuit.

I read the petition last night and was not impressed. There is also a defamation claim in this lawsuit that is really weak.

Without actually seeing the contract, it's hard to know how strong/weak the breach claim is. Since Univision apparently agreed to pay the full $13.5 million owed, I suspect the breach claim is strong and its really about the claim -- pretty weak imo -- for other damages.

Freedom of Speech, in the First Amendment means the government can't suppress speech. Last I checked Univision was a private enterprise and not a branch of a government.
