Clerk Kim Davis loses another appeal in gay marriage case

LOUISVILLE, Ky. (AP) — Kentucky County Clerk Kim Davis lost another legal bid to delay issuing marriage licenses to same-sex couples, marking the latest in a mounting stack of rejected appeals.

Davis, who returned to work this week after five days in jail for defying a federal court order, had again tried to persuade the Sixth Circuit U.S. Court of Appeals to delay a judge's mandate that she issue marriage licenses to all couples.

Davis, the clerk of rural Rowan County, spurred a fiery debate about religious freedom and the rule of law when she refused to issue licenses after a Supreme Court ruling in June that effectively legalized gay marriage nationwide. The American Civil Liberties Union filed a suit against Davis on behalf of four couples, two straight and two gay, and U.S. District Court Judge David Bunning ordered her to issue the licenses, not only to those four couples but also to any other qualified to be married.

Davis defied the order, lost a string of appeals, and opted to go to jail for five days rather than issue the licenses. While she was incarcerated, her deputies issued licenses, altered to remove Davis' name. Both same-sex couples named in the suit received one.

It's unbelievable that an elected official is continually allowed to break the law.

She belongs in jail.

In second thought, look at all the cops that literally get away with murder. This is nothing in comparison.

Nation of laws only for those of us considered to be less than

People that look up the story 3-4 days later that want to comment in LBN can't find it is a very common complaint in email.

And this way you can comment in LGBT or LBN without having to look for it in LBN.

Since I have dementia, I do things a little differently than the old days too.

Apparently, Christian lawyers from Liberty U aren't quite the same as real world attorneys:

The appeals court scrapped that request Thursday on a legal technicality: Davis' lawyers did not first ask Bunning to delay his mandate, as federal court rules require, before they appealed to the higher court. The lawyers, in justifying skipping that step, cited the judge's "extraordinary doggedness." The appeals court wrote that "this is not a valid reason."

They probably graduated from Liberty University.

(I really shouldn't say that. I have a very good friend and former co-worker who just finished her PhD. there. She is not one of those ultra-religious person like most of the students. I was talking to her and she got PT work through the university and says she has to pretended to be ultra-religious because she really needs the experience. I also finished my doctorate recently and building teaching experience and research is important to getting a good position down the road. Unfortunately you have to do everything you can (short of killing someone) to get those kind of things on your CV.)

lawyer, sadly , is a graduate of the University of Kentucky (a school I attended, graduating twenty years later from a regional University, Morehead State) Law school. Although his undergrad degrees are from poduc U.

Because she needs to be declared a vexatious litigant and disqualified from having access to the courts, given her frivolous filings, meritless appeals and contempt of court.

At the very least she should be in jail in order to set a precedent that this behaviour will not be tolerated.

She should shut up and just do her job.

She should also, in my opinion, be personally held responsible for ANY expense that her behavior has cost Rowan County, including but not limited to, the cost for extra security at the courthouse, etc.
