Supreme Court to review Obama's immigration orders

Source: Marketwatch

The Supreme Court will rule on President Barack Obama's authority to shield millions of undocumented immigrants from deportation. The court will likely hear the case in April and issue a decision by late June, reports said. The policy would allow adults in the U.S. illegally to remain if they have children who are U.S. citizens or permanent residents.

That's all there is at the moment. Wonder who decided to accept this one?

I would guess the usual suspects, Scalia, Thomas, Alito and Roberts. But for the Vichy Democratic wing of the party, the last three would not be on the court.

Supreme Court sets election-year clash on immigration

WASHINGTON -- The Supreme Court has agreed to an election-year review of President Barack Obama's executive orders to allow up to 5 million immigrants to "come out of the shadows" and work legally in the United States.

The justices said Tuesday they will consider undoing lower court rulings that blocked the plan from taking effect in the midst of a presidential campaign already roiled by the issue.

The case probably will be argued in April and decided by late June, about a month before both parties' presidential nominating conventions.

The immigrants who would benefit from the administration's plan are mainly the parents of U.S. citizens and lawful permanent residents.

The border state of Texas is leading 26 states in challenging the immigration plan.

Me, I've lived through a lot of Republican Presidents, and seen their overreach, which particularly galled me as a Congressional staffer.

There is a certain amount of good-for-the-goose-good-for-the-gander issue going on here.

The wisdom of the immigration stance is undeniable, but the separation of powers concerns I have is not.

We have checks-and-balances between the federal branches, and there is always tension and gray areas of where something lies.

President Obama's actions were/are on the bleeding edge of what is OK for a president to do under the law. Reasonable minds can differ on whether the office of the President (note: "office" not "Obama" -- that's an important distinction to keep in mind) can do this.

I personally wouldn't mind taking a loss on this issue just to peal back the power of the presidency -- remember the normal state of things for ~100 years is for us to to have Republican president and a liberal/Democratic Congress.

We'd all be bat shit crazy about a President Cruz pushing the envelope in the other direction.

So anyways, I'm willing to lose this battle, short term, to play the long game of balancing power back towards Congress, which will inevitably shift Democratic.

When dealing with issues like this, think 100 years from now. Not today.

I dont know if we can expect that trend to continue in the future, due to widespread manipulation of the electoral process via redistricting and other such measures by the Republicans, while the democrats were cat napping.

course it does scare me regarding immigrants. If the SCOTUS shuts down his actions immigrants will not blame Democrats. The total blame will go to the Rs and their tame dogs in the SCOTUS.

Even many legal immigrants dont side with illegal immigrants, in fact they often see becoming a Republican as a sign of their success in fitting in to their new country.

Tick tock the game is locked and nobody else can play.

or the overall question being presented, not the particulars.
Can the executive branch circumvent the will of the legislative branch?

Can President Obama not deport those here illegally (I say yes) and give them residency status (I say no) when congress has not authorized that action?

Can President Trump stop spending money on enforcing the clean water act (I say yes) and grant new dumping permits for industry (I say no)?
