Former national security adviser Michael Flynn likely broke the law by failing to disclose foreign income he earned from Russia and Turkey, the heads of the House Oversight Committee said Tuesday.
Committee chairman Jason Chaffetz (R-Utah) and ranking member Elijah Cummings (D-Md.) said they believe Flynn neither received permission nor fully disclosed income he earned for a speaking engagement in Russia and lobbying activities on behalf of Turkey when he applied to reinstate his security clearance, after viewing two classified memos and Flynns disclosure form in a private briefing Tuesday morning.
Personally I see no evidence or no data to support the notion that General Flynn complied with the law, Chaffetz told reporters following the briefing.
He was supposed to get permission, he was supposed to report it, and he didnt, Cummings said.

Former National Security Adviser Michael Flynn did not disclose payments for a 2015 speech in Moscow in his security clearance application for 2016, the top Democrat on the House Oversight Committee told reporters Tuesday.
Rep. Elijah Cummings (D-Md.) and Oversight Chairman Jason Chaffetz (R-Utah) sent a request last month to the White House and federal agencies seeking the security clearance applications. Cummings said the White House declined in a letter to provide requested information about Flynn to the Oversight panel.
Flynn resigned as national security adviser after it became clear he had misled his colleagues about the nature of his phone calls with Russia's ambassador.

(50,557 posts)How busting a retired officer works: An officer's retirement grade is the highest rank at which he or she "served satisfactorily."
Major General (Retired) John Smith was commander of 69th Armor Division. While so assigned, one of the colonels in his command liked to visit the barracks at night for sex with his female sergeants. There's a whole string of offenses involved with this shit, and you'll go to Leavenworth for a very long time for it. If during the investigation it comes to light that General Smith knew about it and didn't do anything, the Army will decide the highest rank he served satisfactorily in was Brigadier General, and reduce him to it.
Now it gets fun: If the now-Brigadier General Smith turned out to have ignored a rash of wall-to-wal counseling sessions being held in his motor pool while he was a battalion commander (lieutenant colonel), the Army will decide he last served satisfactorily as a major. They can keep going but if they found out he was fucking up as a second lieutenant they'd have to reinstate him to active duty, court-martial him, strip him of rank and pay and pitch him in the stockade because most of these guys began their careers as officers.
It doesn't work for Flynn because he didn't become a Commie Stooge until after he retired. However, they can still put him in boiling oil.

(1,129 posts)The falsification of data, including the failure to fully disclose all required info., on a Security Clearance Renewal Form SF-86 is a Felony.
This is a separate issue independent from his failure to initially include foreign income on the personal income disclosure forms he submitted in Feb.
According to Cummings, Flynn applied to renew his security clearance - using a form called a SF-86 - in January of 2016, just month after he traveled to Moscow to give a paid speech. During a dinner at that appearance, he was seated with Russian President Vladimir Putin.
There is "no evidence in the documents that he reported funds he received for his trip" and "no evidence he sought permission to obtain these funds from a foreign source," Cummings said Tuesday, noting that knowingly falsifying or concealing a material fact in an SF-86 is a felony.

Of course, he's still a duplicitous scumbag who shouldn't be in public office, but that won't stop the morons in Utah from electing him to other offices.
