HOUSTON (AP) The death of a man who was restrained by an off-duty Texas sheriff's deputy and her husband during a late-night confrontation outside of a restaurant was ruled a homicide on Tuesday, and local authorities are asking state and federal departments to help investigate the incident.
John Hernandez, 24, died of lack of oxygen to the brain caused by strangulation and chest compression, according to the Harris County medical examiner.
Investigators said the May 28 altercation started after Terry Thompson, the husband of Harris County deputy Shauna Thompson, became offended when he allegedly saw an intoxicated Hernandez urinate outside the Houston-area restaurant. They said Shauna Thompson helped her husband restrain Hernandez and that the incident ended with a motionless Hernandez being rushed to a hospital.
He died three days later. The deputy has been placed on administrative leave.

(26,076 posts)Cops, even bad and corrupt ones, at least have to have proper training. Deputies are political appointees, and basically anyone can do it, as long as the Sheriff likes you. This is especially true in certain areas of the country.
But, she should have her badge taken away.

(51,076 posts)should not be anywhere close to a badge or a gun for that matter. I know a gun wasn't part of this story but still my point is. The kind of person who really Wants to be a COP should be scrutinized closely as to motive. I know good cops and I've known a few bad ones and the bad ones should never have been a cop to begin with while the good cops just kinda wind up as a cop rather than a strong desire to be one. I guess some do desire the job to help but I think that is the exception rather than the rule.

(81,488 posts)Texas sheriffs deputy and her husband charged with murder in chokehold at Dennys
By Cleve R. Wootson Jr. | June 9 at 12:06 PM
Days after an off-duty Texas sheriffs deputy was accused of helping her husband choke a man to death outside a Dennys restaurant, both have been charged with murder.
Harris County Sheriffs Deputy Chauna Thompson and her husband, Terry Thompson, were indicted Thursday in the killing of 24-year-old John Hernandez. Hernandez was hospitalized after he was choked during a late-night encounter with the couple May 28, authorities said, and he died three days later. The Thompsons turned themselves in to the authorities Thursday night and were released from jail on $100,000 bail, according to the Associated Press.
The deadly Memorial Day weekend confrontation started outside the restaurant in Sheldon, Tex., 17 miles northeast of Houston. Investigators say Hernandez had been drinking and was urinating outside the restaurant when Terry Thompson approached him. A verbal confrontation turned physical, although its unclear who escalated it, authorities said.
What happened next was captured by a passer-by on a cellphone video. As the video starts, Hernandez is seen facedown on the ground, kicking and struggling to get Thompson off him. Thompson, 41, has his arm locked around Hernandezs neck and uses his chest to pin the younger man to the ground.
