Judge blocks Trump wind-down of Dreamers program

Source: Politico

A federal judge has blocked President Donald Trump's effort to shut-down the Obama-era program that provides quasi-legal status and work permits to foreigners who entered the U.S. illegally as children.

In a ruling Tuesday evening, San Francisco-based U.S. District Court judge William Alsup ordered the administration to resume accepting renewal applications for the Deferred Action for Childhood Arrivals program, better known as DACA.

Alsup said Attorney General Jeff Sessions' conclusion that the program was illegal appeared to be "based on a flawed legal premise."

Unless halted by a higher court, the ruling will allow former DACA recipients who failed to renew by an October 5 deadline a chance to submit renewal applications and will also require the administration to allow renewal of applications expiring in the future. The decision does not permit new applications for DACA status. (One more paragraph @ link)

A federal judge in San Francisco ruled that the Obama-era protections must remain in place while legal challenges to President Trump’s decision are pending.

Trump had ordered DACA, or Deferred Action for Childhood Arrivals, to end by March 5. Nearly 700,000 immigrants who were brought illegally to the United States as children could be at risk of deportation if DACA protections are revoked.
This is a developing story. It will be updated.

A federal judge in California issued a nationwide preliminary injunction Tuesday blocking the Trump administration’s decision to phase out an Obama-era program that shielded young undocumented immigrants from deportation.

The injunction by U.S. District Judge William Alsup says the protections must remain in place for nearly 690,000 immigrants already in the Deferred Action for Childhood Arrivals program while a legal challenge to the decision to end the program proceeds.

Attorney General Jeff Sessions announced the decision to terminate the program on Sept. 5 and said no renewal applications would be accepted after Oct. 5. Under the administration’s plan, permits that expired starting March 5 could not be renewed.

But Alsup rules tha
t while the lawsuit is pending, anyone who had DACA status when the program was rescinded Sept. 5 can renew it, officials said.

Trump says DACA ruling reflects 'broken' court system

BY JORDAN FABIAN - 01/10/18 09:46 AM EST

President Trump on Wednesday blasted a federal court decision preventing the administration from winding down the Deferred Action for Childhood Arrivals (DACA) program, his latest attack on the U.S. legal system.

“It just shows everyone how broken and unfair our Court System is when the opposing side in a case (such as DACA) always runs to the 9th Circuit and almost always wins before being reversed by higher courts,” Trump tweeted.

Trump was responding to a decision from U.S. District Judge William Alsup, which said the government cannot begin shutting down the program while the move is being challenged in court.

The Justice Department said late Tuesday it would appeal the ruling from Alsup, who was appointed by President Bill Clinton to the San Francisco-based court.
