Citizens United loses free speech appeal over New York donor rules

Source: Reuters

FEBRUARY 15, 2018 / 1:13 PM / UPDATED 18 MINUTES AGO

Jonathan Stempel

NEW YORK (Reuters) - A federal appeals court on Thursday threw out a constitutional challenge by the conservative group Citizens United to New York state’s requirement that registered charities disclose their donors annually.

The 2nd U.S. Circuit Court of Appeals in Manhattan rejected claims that the requirement violated the First Amendment because it intimidated donors from contributing, cutting off money needed to conduct free speech, and was a prior restraint on the ability to solicit donations.

Writing for a 3-0 panel, Circuit Judge Rosemary Pooler said New York has important interests in stopping fraud and abuse by charities, and requiring them to disclose names, addresses and contributions of their largest donors makes enforcement easier.

“While we think it plausible that some donors will find it intolerable for law enforcement officials to know where they have made donations, we see no reason to believe that this risk of speech chilling is more than that which comes with any disclosure regulation,” Pooler wrote.

I can copy and paste many articles on what this current and past court has done, but this one case has left us to what is currently happening in this country on the issue of what money is doing to the republic all the way down to guns.............................

We native Hoosiers already know all about the perils of those right wing "conservatives" laws and opinions. Indiana is the last state in the union to outlaw Sunday alcohol "To Go" sales which is being reversed this spring, 2018. The church lobby has managed to make beer/alcohol and spirits sales illegal on Sundays! This is 2018 people. They allow restaurants to serve with food but clubs and bars have to be closed. (at least they get a day off but that's besides the point.)

Roberts, Pence and 45 are all on the wrong side of history.
Money has poisoned the politics and we have to stop it.
somehow.

How do we get money out of politics without losing our republic?
The corruption is deep in our government and we need to fix this shit.
Because fuck that shit.

used to protect the ultra wealthy and pretend that an artificial entity has the same voting powers/rights, and demands of our legislative processes. I would think federal and/or state entities would want to know if donations are in fact valid to take on their tax returns prepared by their citizens, in order to verify suspect returns. Another tool to fight white collar crime, e.g., like the tRUMP family and all of its claims of donations in the past.

This illegitimate supreme court will likely overturn, if the case goes there.
(It is illegitimate because the last appointment was by an illegitimate president and confirmed by a possibly illegitimate Congress).

Corporations have equal rights with citizens, but not equal accountability or responsibility.
