Trump Lawyers Demand Mueller Probe Time Out if Rosenstein is Ousted
Its not even clear yet if the deputy attorney general is actually going anywhere. But Trumps lawyers still want his exit to block, if temporarily, the Russia investigation.

If in fact Rod Rosenstein does end up resigning today, Trump attorney Jay Sekulow said on his radio program on Monday, I think it clearly becomes necessary and appropriate...that there be a step back taken here, and a review, a review that has to be thorough and complete...and basically a time out on this inquiry.
Rudy Giuliani, President Trumps lawyer and former New York City mayor, told The Daily Beast on Monday afternoon that he agrees with Sekulows call for a cessation of the investigation by special counsel Robert Mueller, in the event of Rosensteins ousterwhich was reported to be near as of Monday morning.

Sekulow reiterated that position on his radio show on Monday, suggesting that Rosensteins actions have contributed to an investigative culture inherently hostile to the president. An independent investigator, he said, has to look at all these allegations both surrounding this inquiry and that initiated this inquiry, he said, referring to alleged political bias among FBI investigators probing the Trump campaign and the so-called Steele Dossiers role in prompting it. How do you not address that with all of this going on?
During his radio show, Sekulow endorsed an effort by Sen. Lindsey Graham (R-S.C.) to appoint a second special counsel to investigate the probe undertaken by the first special counsel.

(32,883 posts)Rosenstein will not resign, because of what would happen next. It would mean that Cheeto could appoint any right-wing toady to replace him, who would immediately fire Mueller.
Only Cheeto can fire Rosenstein, not John Kelly, or Sessions or anybody else. If he does fire Rosenstein, look for a huge protest all over this country to happen immediately and right in his face. We will see civil disobedience like we haven't seen since 1968. Just in time for the November elections too.

Our legal process doesn't give a shit about how many Instagram views came in for you today or how many Facebook likes you have. If you break the law, and there is evidence to support it, you're fucked.
Trump and his GOP enablers, on the other hand, think that everything can be "spun". To them, justice happens in the court of public opinion. They need to get their "message" out there. So they work the crowd with their cable news and Tweets to, ultimately, get 30% of the US population supporting them. In the meantime, the rest of the population hates them, and the law is STILL the law.

(23,946 posts)Rosenstein is definitely coming to the White House, Anonymous in the WH finds out, knowing Sessions was merely being replaced by Rosenstein for some reason for an already scheduled meeting with Sessions. Not abnormal but no one outside the WH does knows this...nor did Axios.
Staffer with Rosenstein calls Anonymous who calls Axios.

(5,586 posts)Noel Francisco, the Solicitor General, is who Mueller reports to if Rosenstein is fired / resigns / dies / etc. Francisco seems every bit a Trump loyalist. The administration would be smarter to kill the probe through management rather than up and firing everyone.
Stuff like not approving lines of investigation, quashing warrants, not approving expenses, budget cuts, etc. They should look like they're investigating, but in the end not really accomplishing anything. Then they can control what goes in the report and squash it that way.

My understanding is only the deputy director can fire or otherwise direct Meullers actions.

The question of who would oversee the Russia probe is slightly different, however, because Rosenstein has been effectively wearing two hats since Attorney General Jeff Sessions recused himself last year from any role overseeing Robert Mueller's investigation. One hat is that of deputy attorney general. The other is that of acting attorney general for the Russia probe, because Rosenstein was acting as a stand-in for Sessions.
Any replacement of Rosenstein by Trump, therefore, would be a replacement of his deputy attorney general position, not a replacement of the other role, acting attorney general for the Russia probe. That responsibility would go to Solicitor General Noel Francisco, and experts agree that the law gives Trump little control over that aspect of the succession.

Did you read the experts agree link at CNBC? It seems to be a blog, with no citations that I could find, only opinions. I think CNBC is on shaky ground with this assertion- it may end up as a Constitutional Crisis...

(5,586 posts)The government doesn't allow for powerful, investigative positions with no accountability. That lack of accountability is basically why Trump was allowed to appoint Mick Mulvaney to head the CFPB.
And if the US government did have positions of powerful, non accountable people making serious decisions; we should all fear for our lives and liberty.

Why stop an investigation that just wracked up another conviction only ten days ago?

(37,648 posts)to see if he can run the Mueller investigation. If not, then a new guy will be appointed to do that, and he'll have to be vetted. Then he'll need to get up to speed, read about the investigation to date (and there's a lot to get up to speed on).
The whole point of the plant in the NYT article was to stop the Mueller investigation before they could get Kavanaugh on the S.Ct. and/or the mid-terms, or both.
