White House tells Acosta his press pass will be suspended again when order expires, CNN says

White House officials have reportedly sent a letter to CNN’s Jim Acosta indicating they will suspend his press pass again once the temporary restraining order that required them to restore Acosta’s credentials expires, CNN reported late Sunday night. The 14-day order was issued Friday, and unless the judge extends it, it would expire at the end of the month.

The action was telegraphed Friday by press secretary Sarah Huckabee Sanders, who said that the White House would “temporarily reinstate” Acosta’s credentials in response to a court decision in his favor.

In a ruling seen as a victory for press freedom, U.S. District Judge Timothy J. Kelly, appointed by President Trump, ordered the White House to temporarily restore Acosta’s press pass on Friday while he considers the merits of the case and the possibility of a permanent order.

He said the White House has an obligation to afford due process to Acosta before it can revoke or suspend his access, and found that the White House’s decision-making process in this case was “so shrouded in mystery that the government could not tell me .?.?. who made the decision.”

Acosta wasn't given back his press pass because of the 1st Amendment but because of the 5th. The judge merely said the White House needs a process that it can follow to revoke people's credentials.

Anyone old enough to remember Helen Thomas? Like when she asked W. at a press conference, what are the real reasons we invaded Iraq, was it for oil or for Israel?

...if not CNN's attorneys will do so. The judge could rule that Sanders is acting in bad faith and either extend the restraining order or make it permanent.

Judges, right or left leaning, don't like being "mocked" by litigants.

CNN just announced that they've asked for an emergency hearing about this. I don't know when it'll be, but the judge will probably bite back on this one.

Judge Kelly issued a TRO, one of the requirements of which is that the Plaintiff (CNN/Acosta) is likely to prevail on the merits. Kelly is currently deciding whether to make the injunction permanent. I think Trump's tantrum probably just decided the issue for him.

CNN on Monday requested an emergency hearing in the U.S. District Court after the White House threatened to again pull the press credentials of the network's chief White House correspondent Jim Acosta.

The network in the new court filing said White House officials on Friday sent Acosta a letter stating his press pass would be revoked again after a court-ordered temporary restoration expires at the end of the month.

White House communications official Bill Shine and White House press secretary Sarah Huckabee Sanders in the letter to Acosta called the decision to revoke his press pass "preliminary," warning it would be "final" soon.

They offered the White House reporter the option of submitting a "written response" by Sunday, a deadline that CNN in the filing said was set "arbitrary."
