Court rules for U.S. in fight over Nevada plutonium shipment

RENO A federal appeals court has ruled against Nevada in a legal battle over the U.S. government's secret shipment of weapons-grade plutonium to a site near Las Vegas.

A three-judge panel of the 9th U.S. Circuit Court of Appeals on Tuesday denied the state's appeal after a judge refused to block any future shipments to Nevada.

The court in San Francisco says the matter is moot because the Energy Department already sent the radioactive material and has promised that no more will be hauled there.

Nevada also wanted the court to order the government to remove the plutonium it shipped to Nevada last year but didn't reveal until January.

The 9th Circuit says that issue also is moot because the state failed to include that request in its original court filings.

1. NEVADA TEST SITE

This is located 90 miles from Las Vegas. During the 70's I worked at NTS doing nuclear bomb tests. We assembled a test device which can do everything without requiring a nuclear bomb. The DOE routinely has a super secret truck (SST) with moves "material" all over the country. Two vehicles follow the truck (ahead and behind) with heavy duty weapons to protect the truck. The truck is like an armored truck so nobody would even think about attacking the SST. This is safer then FLYING special nuclear material (SNM.) The drivers have a "Q" security clearance which is way above Top Secret (TS.)

2. Thanks. I think Nevada's issue is that the material is there, not how or who gets it there.
