Michael Flynn deserves up to six months in prison, U.S. Justice Department says in reversal
Source: Washington Post
Federal prosecutors on Tuesday recommended that former national security adviser Michael T. Flynn serve up to six months in prison, reversing their earlier recommendation of probation because of his drawn out attacks against the FBI and Justice Department. The dramatic revocation of the Justice Departments request for leniency came weeks after Flynns sentencing judge on Dec. 16 categorically rejected Flynns claims of prosecutorial misconduct and that he had been duped into pleading guilty to lying to FBI agents about his Russian contacts after the 2016 U.S. election.
It is within the governments sole discretion to determine whether the defendant has substantially assisted the government, prosecutor Brandon Van Grack wrote in a 33-page court filing. In light of the complete record, including actions subsequent to December 18, 2018, that negate the benefits of much of the defendants earlier cooperation, the government no longer deems the defendants assistance substantial. Flynn faces sentencing Jan. 28 before U.S. District Judge Emmet G. Sullivan in Washington, D.C. Flynn defense attorney Sidney Powell is scheduled to file his sentencing request on Jan. 22.
The government motion marked the latest twist in the legal saga of the former Army lieutenant general and Trump adviser, whose rocky path after his candidate won the White House included serving the shortest tenure of a national security adviser on record just 24 days. He then became a key witness in a probe into the administration, before breaking with the prosecutors who had credited him for helping them.
Flynns actions punctuated the beginning and end of special counsel Robert S. Mueller IIIs probe of Russian election interference, and his latest change of heart came after the investigation formally closed last March. Some Trump allies at that time pushed the president to pardon figures in the probe, particularly Flynn, calls that potential prison term could renew.

(8,791 posts)Really beginning to hate and be sick in my gut for a country I served during war. We do not deserve democracy. Just shit it away. Thom Hartmann's opening today about the last nine years of Hungary political takeover is like reading the GOP playbook and trumps eventual life long appointment. They did it in 9 years. You think trump, and GOP can't accomplish it in 8 years?
One big spoiled rotten child, too busy to do one damn thing for our democracy. We deserve what is coming. Too busy to fucking vote. Vietnam vets crawl over glass to vote to not repeat history. But, they are dying without proper care. So young people, live with poison, cancer, no health care, and war. Too busy.

(4,986 posts)And measured in giving Flynn a slap on the wrist. Her restraint had nothing to do with being appointed by tRump AND being on his transition team. Gosh, she may have worked alongside flynn when he was up to no good, and wasnt at all a possible witness to his activities. No way, couldnt happen with this lot.

In March 2019, President Donald Trump said he would nominate Liu to become United States Associate Attorney General, but she withdrew her name from consideration later that month because the Republican-controlled Senate Judiciary Committee objected to her nomination.[7][8][9]
On December 10, 2019, President Trump announced his intent to nominate Liu as Under Secretary for Terrorism and Financial Crimes at the Department of the Treasury.[10]
