Trump to pardon women's suffrage leader Susan Anthony

President Donald Trump said Tuesday he will pardon Susan B. Anthony, a leader in the women’s suffrage movement, who was arrested for voting in 1872 in violation of laws permitting only men to vote.

Anthony is best known for her role in the movement to secure voting rights for women, but she also was a strong anti-slavery and voting rights pioneer.

“She was never pardoned,” Trump said. “What took so long?” He said he would sign “a full and complete pardon later Tuesday.

Trump’s pardon comes 100 years after the ratification of the 19th Amendment, which ensured women the right to vote. It’s also known as the Susan B. Anthony Amendment. His move also comes amid an outcry over Postal Service disruptions that Democrats say endanger the voting rights of millions of Americans who would vote by mail in November amid the pandemic. Trump has denied asking for the mail to be delayed even as he leveled fresh criticism on mail-in voting.

this is a common misconception based on what's surely dicta from burdick v. united states.

that case simply found that accepting a pardon and producing it in court had to be a voluntary act on the part of the recipient; the government couldn't force a pardon on someone in order to deprive them of their 5th amendment right not to testify against themselves.

in susan b. anthony's case, she certainly accepted that she had broken the law, but it was an unjust law she felt ought to be broken and repealed. she might well have refused a pardon anyway, if she felt that a continued prosecution would help the cause. but in practice, once a pardon is granted, prosecution efforts tend to slow down considerably....

by DNA evidence.
A pardon says, “you certainly committed the crime, but due to circumstances, we’re going to say it’s ok.”
An exoneration says, “we totally screwed up in convicting you for the crime. That was our bad. You’re out of prison now.”
Some times a pardon would require admission of guilt, because the parties in power want you to at least feel some contrition for committing the crime.
Exoneration requires nothing of the sort, because you didn’t do anything.

Certainly most pardons are for people who actually are guilty, and for them, yes, presidents and governors usually insist on an admission of guilt and a display of contrition and remorse, essentially as part of the application process.

And presidents and governors likely would not ask for that in cases where they find the law unjust, the process unfair, or the person actually innocent.

But legally, a pardon is a pardon, whatever the reason.

In any event, I think we're agreeing that Susan b. Anthony would not have to admit guilt whether she accepted Donnie's pardon or not.

Interestingly, the conviction likely wouldn't have held up anyway because the judge directed the jury to find her guilty(!). Years later the Supreme Court finally said trial judges can't do that.

In practice, the judge fined her but said he wouldn't jail her if she didn't pay. So she never paid.

This morning, I told my BFF about seeing him engage in some of his self-indulgent drivel in front of the cameras and thinking--Putting aside all the truly awful things that he has done, I just want him gone because I am so sick of his whiny, self-absorbed verbal garbage.
