'The Supreme Court ruled in favor of scam artists,' FTC chief says after justices gut agency's power

The Federal Trade Commission can’t force companies that engage in wrongdoing to pay back consumers or give up ill-gotten profit, the Supreme Court held Thursday, dealing a huge blow to the agency that could hamper its antitrust and privacy cases.

The FTC’s authority under a provision known as Section 13(b) is limited to seeking an injunction to stop illegal actions and doesn’t authorize it to seek monetary remedies like restitution, Justice Stephen Breyer wrote for the unanimous court.

Section “13(b) as currently written does not grant the Commission authority to obtain equitable monetary relief,” Breyer wrote, noting that the FTC can seek restitution under other provisions of the law. “If the Commission believes that authority too cumbersome or otherwise inadequate, it is, of course, free to ask Congress to grant it further remedial authority.”

Acting FTC Chair Rebecca Kelly Slaughter slammed the ruling, saying it deprived the FTC of its strongest tool to help consumers.

1. My daughter answered one of those utility switching spam calls and was chatting with the guy.

.

She said she was living in a small building in the backyard of this couple's home.

The guy, who was from India, asked her if she had the couples social security number and other information.

She asked why she would want that.

The caller said that with that information, she could scam them out of money too.

Most of those places record what you say and could send that to Five-O acting as a 'concerned' person.

And that, apparently, eating human livers is against the law in this country - and I'm going to jail for it. I really don't have a need for auto warranties, gas/electric discounts, or my Amazon account updated.

If they persist, I tell them they sound delicious.

I've had multiple return calls from the warranty folks where they ask for Mr. Lecter.

it had the wrong number of digits. I asked if it's part of the green new deal and if they use wind turbines or solar panels. Dude was getting so irritated. He had no idea where I live or my name.

Sounds like this decision is based on statutory interpretation, and being unanimous makes it strong; NEED changes in the statute.

The lesson there is to make sure that all legislation contains every imaginable scenario and provides penalties, etc. The burden is on Congress to do their jobs. If republicans don't vote for it, that's fine as along as the Democrats hold firm as a bloc.

The reality is that you really can't have unity with a party whose response to everything is no.

So, while we have the majorities, fuck 'em. And, who knows, maybe it will be even better after the midterms.

7. Neither lawyers nor lawmakers are trained in engineering

IMHO they should be.
They can cause just as much damage as a faulty sprocket by not looking at all the possibilities and their consequences. Stop writing 600 page laws that purport to address 10 issues, all badly. Instead write 10 * 60 page laws that each address one issue comprehensively.
They might even be easier to understand and get adopted.

22. I tell them I work at Mark Thomas Ford.

After I get their name I ask if they've driven a Ford lately. Then they usually go back to the script, but I going back to that new Ford. I tell them it's the end of the month and I have to move these Fiestas out the door. After letting them bait to hook a little longer I ask to discuss that Fiesta again, pointing out that I can put them in a new Ford Fiesta for 29,999, and these cars aren't stripped, they're equipped, so whaddya say "Jason".

If they're sticking around I ask what they drive and ask what I have to do to put them in that new Ford, and they have their choice of colors. "If I agree to Senior Benefits or changing my gas company will they take a test drive". Usually they tell me to suck their dick or just hang up.

Turns out they don't like it when someone sells them something on the phone.

23. Another good one is ask right away if you can record this phone call.

Then ask them to spell their name and say the company they work for.
They usually say no or hang up, but if they stay on the line, you can have fun with it. Start getting personal and ask them direct questions about how long they've worked there and where they're located. What phone number are they calling from and what's the weather like there. Do they have a middle name?

Make them feel they're on the witness stand.

26. This Law Has Probably Been On The Books For 50 Years Or More

So what happened that now it is unconstitutional? And this decision was unanimous at that. Looks like more legislating from the bench.
