Trump sues Jan. 6 committee, National Archives

Donald Trump is suing the Jan. 6 select committee and the National Archives to block the release of his White Houses records related to the Capitol attack.
The former presidents lawyers filed the suit in D.C. district court on Monday. It names the Jan. 6 panels chair, Rep. Bennie Thompson (D-Miss.), and the national archivist, David Ferriero, along with the committee and the archives. And it calls the Jan. 6 probe a vexatious, illegal fishing expedition.
In the lawsuit, Trumps lawyers ask a federal judge to declare the entire request from the select committee to be invalid and to block the National Archives from turning over any materials to Congress in response to the request. They also specifically ask the court to block the Archives from turning over any documents that Trump says are covered by executive privilege.

I am not impressed with this lawsuit. TFG is not POTUS and the Presidential Records Act is not unconstitutional simply because TFG does not like it

"it is argued, such claims may be asserted only by incumbents who are presently responsible to the American people for their action. We reject the argument that only an incumbent President may assert such claims, and hold that appellant, as a former President, may also be heard to assert them."
The Court went on to say:"we think that the Solicitor General states the sounder view, and we adopt it:
"This Court held in United States v. Nixon . . . that the privilege is necessary to provide the confidentiality required for the President's conduct of office. Unless he can give his advisers some assurance of confidentiality, a President could not expect to receive the full and frank submissions of facts and opinions upon which effective discharge of his duties depends. The confidentiality necessary to this exchange cannot be measured by the few months or years between the submission of the information and the end of the President's tenure; the privilege is not for the benefit of the President as an individual, but for the benefit of the Republic. Therefore the privilege survives the individual President's tenure."
Ultimately, as that case makes clear, where the incumbent president disagrees with the former president, the incumbent's views as to whether the privilege is appropriate are entitled to great weight. But it simply is wrong -- clearly -- to say that Trump cannot assert executive privilege. The courts may (and should) reject that claim, but not on the grounds that he has no standing to make it.

Since the issue of people failing to honor their legal duty to appear before the committees that haved subpoenaed them during the last administration, and at the start of this one, it should concern all of us. As citizens who recognize that our opposition wants to deny us our rights -- starting with the right to vote and have all votes counted -- we should be informed about the process that begins to unfold tomorrow. I am sure that there are others here who are better informed than me, but I still wanted to share a link to a site I find helpful:

It is a report on by legislative attorney Todd Garvey, that provides a good amount of information. Garvey has served in that position in the American Law Division of the Congressional Research Division since 2009. I found some of the most important and interesting information started on page 34. Most of the past cases involve a conflict between Congress and the Executive branch, for only an administration can claim executive privilege.
The Biden administration is not attempting to cover-up for the Trump cult. Donald Trump has no legal status that allows for executive privilege. Steve Bannon was not part of the administration at the time in question. Not to mention that claims of executive privilege tend to admit that the January 6 insurrection was a White House operation.

(42,700 posts)I'm glad Biden is rejecting his claim and remain hopeful that the court's will rule in favor of Biden's decision, but the argument that someone asserting a right not to testify or comply with a subpoena or to resist a warrantless search (whether under the fifth amendment or executive privilege or any other form of privilege) should be presumed to be hiding guilt is something that I expect to hear from right wingers, not DUers.

WashingtonChairman Bennie G. Thompson (D-MS) and Vice Chair Liz Cheney (R-WY) today made the following statement:
The former Presidents clear objective is to stop the Select Committee from getting to the facts about January 6th and his lawsuit is nothing more than an attempt to delay and obstruct our probe. Precedent and law are on our side. Executive privilege is not absolute and President Biden has so far declined to invoke that privilege. Additionally, theres a long history of the White House accommodating congressional investigative requests when the public interest outweighs other concerns. Its hard to imagine a more compelling public interest than trying to get answers about an attack on our democracy and an attempt to overturn the results of an election.
The Select Committees authority to seek these records is clear. Well fight the former Presidents attempt to obstruct our investigation while we continue to push ahead successfully with our probe on a number of other fronts.

(7,263 posts)For someone with a 0-72 (or whatever) legal record against the US Government over the last year it is a bit of a long shot.
I don't think it will delay things by that much - I would expect this one to be settled ( i.e. thrown out) rather quickly as these things go.
