BREAKING: Fulton DA requests special grand jury for Trump probe

Fulton County District Attorney Fani Willis is requesting a special grand jury to aid in her investigation of former President Donald Trump and his efforts to overturn Georgias 2020 election results.
In a Thursday letter to Christopher S. Brasher, chief judge of Fulton Countys Superior Court, Willis said the move was needed because a significant number of witnesses and prospective witnesses have refused to cooperate with the investigation absent a subpoena requiring their testimony.
She cited comments Secretary of State Brad Raffensperger made during an October 2021 interview with NBC News Chuck Todd, in which he said if she wants to interview me, theres a process for that.

(9,988 posts)The more investigations he faces, the better. Surely one of them will have consequences. Ive lost faith that anything will be done at the federal level, though some of his accomplices may well be in trouble. Unfortunately, being convicted of a crime does not necessarily mean that he cant run for president in 2024. I saw an article this morning (CNN) that said he is definitely running because he thinks the DOJ rule of not prosecuting sitting presidents would protect him from these investigations. Plus, he would try to pardon himself.

(14,750 posts)Though you are correct, there is no restriction that a person convicted of a felony cannot run for potus.
But, there are still some civil war era crimes on the books that could prohibit a person from being on the ballot in some states. It all depends on what he is charged with.
So keeping him off the ballot in a state like GA would certainly hurt his chances.

In criminal cases, most courts (state and federal) require a unanimous vote by the jury to find the defendant guilty.
Currently, courts in only two states allow for conviction of a defendant via non-unanimous voting, and those are generally reserved for minor charges.
Note: Federal military courts-martial, a special form of Article I federal court that enforces criminal actions, allows for a non-unanimous finding of guilty in certain cases.

(3,392 posts)The fact that Raffensperger decided to record the SOB just tells us that he tried it before, but Raffensperger wanted to have it in audio as proof, and if Raffensperger has any "integrity" he won't even need a subpoena to testify.
I really don't get it, I know, it just makes my blood boil...I can investigate the corruption of the buffoon in an hour and a couple of minutes, and only because I would be forced to listen to the audio again...
Get the audio, which they already have. Subpoena everyone on the phone call to testify (and don't give them a week or two to appear, next Wednesday is fine), then indict the SOB, set up a trial ASAP and then throw the SOB in jail.
How difficult is that?

no cooperation then next step is compelled testimony
need grand jury for that and it goes on and on to indictment, trial, appeals
thats the rules of law. Thats way America justice works for all as all are equal under the law, even the tRump demons.
The real law in the real world presumes Innocent Until Proven Guilty
beyond a reasonable doubt in a court of Law, no Twitter jurist will be empaneled.
Thats much tougher job.

BTW the lawyer for the Sec. of State's office in GA has TFG on tape saying something like just say there is

There will be a tipping point when the RNC cuts him loose. How much money will they throw into the bottomless pit before they realize it's a lost cause? Can't wait to see it.

In her letter to Christopher S. Brasher, chief judge of Fulton Countys Superior Court, Willis cited several advantages to impaneling a rarely used special purpose grand jury.
Among them: It could sit for a longer period of time than a normal grand jury and it would focus solely on the matter at hand, which she called appropriate to the complexity of the facts and circumstances involved.

(79 posts)you see, I'm in my early 60s, and done okay. I'm not rich, but comfortable. Got everything I need, and most of what I want. However, I now find that I want at least one of these two things. First, that TFG goes to jail, second, that TFG goes bankrupt. I don't know which would be worse for him. So you see, I'm not asking for much. But what I'm asking for, I insist upon. Does anyone else feel so aggrieved as I do that it is almost all that I want now?

Fulton County District Attorney Fani Willis requested last week to seat a special grand jury starting May 2. Fulton County Superior Court judges approved the request on Monday.
Though the special grand jury does not have the authority to issue an indictment, the move will allow Willis to seat a panel entirely focused on gathering evidence in the Trump investigation. She said she needed such a grand jury in order to issue subpoenas to compel witnesses to testify and to gather additional evidence -- a step toward pursuing possible criminal charges......
"The people of Georgia are angry, the people of the country are angry. And there's nothing wrong with saying that, you know, um, that you've recalculated," Trump said during the January 2021 call. Raffensperger responded, "Well, Mr. President, the challenge that you have is, the data you have is wrong."
