Lawmakers urge Biden to ask Congress before sending military to Ukraine

Agroup of lawmakers sent a letter to President Biden on Tuesday amid escalating tensions in Ukraine to remind him that he must seek authorization from Congress before sending in troops or launching military attacks.

The bipartisan group of 43 lawmakers acknowledged that Biden previously said he would not send troops into Ukraine but noted the decision could change.

If the ongoing situation compels you to introduce the brave men and women of our military into Ukraine, their lives would inherently be put at risk of Russia chooses to invade," the letter reads. "Therefore, we ask that your decisions comport with the Constitution and our nation's laws by consulting with Congress to receive authorization before any such development."

The letter was signed by Reps. Nancy Mace (R-S.C.), Pramila Jayapal (D-Wash.), Ilhan Omar (D-Minn.), Matt Gaetz (R-Fla.) and Warren Davidson (R-Ohio), among others.

Agreed, President Biden has been unequivocal about not sending US troops to Ukraine, and I agree, we don't want to be in a shooting war with Russia under almost any circumstances.

However, if they attack any of our actual NATO allies, that would change the equation.

I am of the opinion that if they go "all in" against Ukraine, their hands will be too full to be able to effectively threaten any actual NATO members afterwards.

arises where an action is necessary, the president can commit to a military action, without the approval of Congress.

The only requirement is that the President needs to notify Congress within 48 hours of such an action, and not to continue such an action for more than 60 days, plus a further 30-day withdrawal period without Congressional authorization for use of force or a declaration of war.

A President must have that power. As Commander in Chief he can order defensive or offensive action at a moment's notice for the simple reason that getting the approval of hundreds of legislators before any action, could leave the country defenseless if attacked, and announcing offensive actions in advance of a target would put our people in more danger.

What Congress has is the power of the purse, and they could cut off such funding if an action occurs for more than 60 days.

Prior to that they passed the 2001 Authorization for the use of military force in Afghanistan, and that went beyond initiating war in Afghanistan against Al qaeda, but gave the executive branch almost limitless and indefinite authorization to wage war from the 9/11 attacks

Better examples would have been Syria and Libya

There was a trip wire in the UNMC that sold a number of people. That trip wire was that military action was authorized only if Saddam would not allow the weapons inspectors perform their inspections. He did, so the war that was fought was not the war that was authorized.
