Capitol rioter gets 34-month term for assaulting police and journalist

A former carpenter from Pennsylvania who pleaded guilty to assaulting police officers and a photojournalist during the Jan. 6, 2021, riot at the U.S. Capitol was sentenced Friday to 34 months in prison after apologizing in court for his actions and saying he behaved like “an antagonistic jerk” on the day of the siege.

“Regretfully, I let my emotions get the best of me, and I’m very disappointed,” the defendant, Alan W. Byerly, 55, told Judge Randolph D. Moss in U.S. District Court in Washington. “But make no mistake: This was no excuse for me to put my hands on anyone. … I was being an antagonistic jerk, and I still can’t understand why I was like that.”

Byerly, a divorced father and grandfather who had lost his carpentry job during the pandemic, said he was experiencing “depression, frustration and isolation” when he traveled to Washington to attend President Donald Trump’s incendiary rally Jan. 6 on the Ellipse, at which Trump repeated his debunked claim that rampant voter fraud had led to his defeat in the 2020 election.

Carrying an electric stun device “for protection,” Byerly said, he then joined thousands of Trump supporters as the mob stormed the Capitol while Congress was meeting to confirm Joe Biden’s victory in the presidential election. Later, in the months before his July 2021 arrest, Byerly said, “I felt so bad” about the riot that “I wouldn’t even tell the closest people in my life about January 6th.”

452 still stand convicted. What's puzzling is why they haven't yet been sentenced, since at least half of them have been convicted since April of last year.

These people who make an apology as if somebody else did the crime. It was because he was depressed, you know. The real him would NEVER have been violent or destroyed property.

Had to take it out on someone. Hey, look there's a cop...

Also, I am in the trades. NO tradesmen lost their jobs because of the pandemic. There was more work than EVER. Everyone wanted to renovate or build a home office or make a "covid haven" porch or whatever. Flat out from then till now.

That guy is just a whiny loser. Oh, and now a convicted, and sentenced, insurrectionist. A big loser with time in the Gray Bar Hotel to think about his lot in life. Good luck finding any work when you get out, loser.

First degree assault in Oregon is a Class A felony which will result in punishment of up to 20 years in prison and fines up to $375,000. Second degree assault in Oregon is a Class B felony which will accrue up to 10 years in jail and fines up to $250,000.

Okay, so this is not an Oregon case, just a perspective from where I live. 34 months is a little slap on the wrist, and we are seeing a lot of this.

I'm sorry there were plenty of depressed and sad people during the pandemic and they didn't go to Washington DC with the stun gun and beat up police officer

Did the courts really fall for his Bullshit excuse?

I've seen video of police officers just shoot a man for being mentally ill
But this guy can go all the way to Washington DC with the stun gun and only get 34 months in prison.

This country put a black man in prison for 50 years for stealing $50.

But this guy gets 34 months for beating up a cop. because he was depressed 🖕🏾🖕🏾🖕🏾

You wonder why this democracy is so easily toppled. They put a group of people in charge to think they're better than everybody else. And now not even this government here is to control them properly because 34 months is pathetic.
